2. That PfeiffeK ~td, is~r~eby granted a use permit pursuant to <br />Section 40'43.1 of the COde of th6 City of pOrtsmouth, Virginia (1988)for <br />the operation of an entertainment establishment to be located at 606 and <br />610 High Street, being more particularly described as: <br /> <br />UP-98-15 <br /> <br /> Beginning at a point 60'+ from the northwest corner of the <br />intemection of High Street and Washington Street; thence, north 83'+ to a <br />point; thence, west 30'+ to a point; thence, north 30!+ to a point; thence, <br />west 30'+ to a point; thence, south 22'+ to a point; thence, in a <br />southwesterly direction 15'+ to a point; thence, west 6'+ to a point; thence; <br />south 78'+ to a point; thence, east 82'+ to the point of the beginning. <br /> <br /> 3. That this use permit is approved subject to the following <br />conditions: <br /> <br />(a) There shall be no more than 124 patrons in the <br />establishment at any time. <br /> <br />(b) All actiVities on the site shall cease by midnight. <br /> <br />(c) Any alterations to the exterior of the property must be <br />submitted to the Downtown Design COmmittee for review and <br />approval. <br /> <br />(d) The project shall be developed and operated in accordance <br />with a floor plan, identified as Exhibit A, and a letter from <br />Arden H. Pfeiffer, President of Pfeiffer Ltd,, to the City of <br />Portsmouth Planning Commission, dated September 18, 1998, <br />identified as Exhibit B, both Exhibits being attached hereto <br />and made a part hereof. <br /> <br />(e) All taxes owed on the Subject property or in connection <br />with the proposed operatiOn shall be paid when due. <br /> <br />(f) All activities conducted on the subject property shall <br />comply with the City of Portsmouth Noise Ordinance, as <br />established in SeCtion 24-255 of the City Code. <br /> <br />(g) The applicant shall operate the entertainment <br />establishment in accordance with all applicable codes, <br />ordinances and regulations of federal; state and local <br />governments, and shall obtain and maintain in effect all <br />necessary licenses and permits, <br /> <br /> (h) The use permit shall not be transferable. <br /> <br /> 4.
