2. That PfeiffeK ~td, is~r~eby granted a use permit pursuant to Section 40'43.1 of the COde of th6 City of pOrtsmouth, Virginia (1988)for the operation of an entertainment establishment to be located at 606 and 610 High Street, being more particularly described as: UP-98-15 Beginning at a point 60'+ from the northwest corner of the intemection of High Street and Washington Street; thence, north 83'+ to a point; thence, west 30'+ to a point; thence, north 30!+ to a point; thence, west 30'+ to a point; thence, south 22'+ to a point; thence, in a southwesterly direction 15'+ to a point; thence, west 6'+ to a point; thence; south 78'+ to a point; thence, east 82'+ to the point of the beginning. 3. That this use permit is approved subject to the following conditions: (a) There shall be no more than 124 patrons in the establishment at any time. (b) All actiVities on the site shall cease by midnight. (c) Any alterations to the exterior of the property must be submitted to the Downtown Design COmmittee for review and approval. (d) The project shall be developed and operated in accordance with a floor plan, identified as Exhibit A, and a letter from Arden H. Pfeiffer, President of Pfeiffer Ltd,, to the City of Portsmouth Planning Commission, dated September 18, 1998, identified as Exhibit B, both Exhibits being attached hereto and made a part hereof. (e) All taxes owed on the Subject property or in connection with the proposed operatiOn shall be paid when due. (f) All activities conducted on the subject property shall comply with the City of Portsmouth Noise Ordinance, as established in SeCtion 24-255 of the City Code. (g) The applicant shall operate the entertainment establishment in accordance with all applicable codes, ordinances and regulations of federal; state and local governments, and shall obtain and maintain in effect all necessary licenses and permits, (h) The use permit shall not be transferable. 4.
