Robert Henn, 3818 East Rivanna River Reach, spoke in support of the use <br /> permit. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to postpone action <br />on (b) UP-98-14 until the Midtown Comprehensive Land Study has been <br />completed, and was adopted by the following vote: <br /> <br />Ayes: Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: Benn <br /> <br />98-253 Use permit application: <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />98-253 (c): <br /> <br /> "RESOLUTION GRANTING A USE PERMIT TO PFEIFFER LTD. FOR THE <br />OPERATION OF AN ENTERTAINMENT ESTABLISHMENT AT 606 AND 610 HIGH <br />STREET. <br /> <br /> WHEREAS, Pfeiffer Ltd. has made application pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use <br />permit to operate an entertainment establishment, to be located at 606 and 610 <br />High Street, Portsmouth, Virginia, as hereinafter-described; and <br /> <br /> WHEREAS, the applicants and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of <br />said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing <br />or working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the <br />property or improvements in the neighborhood; <br /> <br />(c) Is compatible with and will not adversely affect or be materially <br />detrimental to adjacent uses, residents, buildings, structures, or <br />natural resources; <br /> <br />(d) Will be provided with sufficient landscaping to insure com- <br />patibility with surrounding uses; <br /> <br />(e) Will be a project that will be developed according to a plan for <br />parking, driveways, and curb cuts which will provide for safe and <br />convenient traffic movement; and <br /> <br />(f) Will be in accordance with the purposes of the City of Portsmouth <br />Zoning Ordinance. - <br /> <br /> <br />
