November 10 !970 <br /> <br /> WHEREAS, b7 another order entered by the said Court of Hustings of the City of Portsmout~ <br />on the Ninth da7 of November, 1970, it was entered of record as a result of said election <br />that a majority of the votes were cast for the bond issue, and that the Council of the <br />City of Portsmouth be fully authorized and empowered to prepare and issue and to sell <br />or to negotiate said bonds upon the faith, credit and property of said municipality in the <br />amount so authorized; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL-OF THE CITY OF PORTSMOUTH, VIRGINIA: <br />Section 1. Pursuant to Section One Hundred and TwentySeven, Clause (b), of the Constitu~ <br />tion of Virginia and Chapter S of Title 15.1 of the Code of Virginia~ 1950, the referred <br />to ordinance and under and by virtue of a majority of the votes cast "For Bond Issue", at <br />an election of the qualified voters of the City of Portsmouth held on the third day of November, <br />1970, in order to acquire certain port improvements and to construct certain additional port <br />improvements, which shall constitute a revenue producing undertaking of the City, the City <br />of Portsmouth shall borrow the sum of Eight Million Tw° Hundred Thousand Dollars of Port <br />Improvement Bonds, and the proceeds arising from the sale of said bonds, or any of them, <br />shall be applied to the payment of the costs of such acquisition and construction, and to <br />no other purpose. The said bonds shall be serial bonds and shall be issued at one time or <br />a part thereof from time to time and shall be in such form and of such denomination not exce~ <br />ina forty (40) years from its date, and said bonds shall bear interest at a rate or rates <br />to be hereafter determined by the Council, upon the sale of said bonds, provided that the <br />maximum rate of interest shall not exceed the maximum rate of interest authorized by law <br />at the time of sale of said bonds. <br /> <br />SECTION 2. This resolution shall take effect from its passage." <br /> <br />Ayes: Holley, Johnson, King, Smith (I), Smith (r), Turner, Barnes <br />Nays: None <br /> <br /> 70-491 "I submit the attached resolution and recommend its adoption. This authorizes <br />submission of an application for federal funds on various sewer projects. The following <br />projects are included in this application: <br /> <br />Chandler Harper Drive Pumping Station <br />Melvin Drive Pumping Station <br />Greenwood Drive Pumping Station <br />Manor View Sewers <br />Elizabeth Acres and Mayflower Park Sewers <br />Mimosa Cove and Cedar Point Sewers <br /> <br /> All of the above projects have been authorized by the City Council, and some are under <br />construction. We have not established a dollar amount in this application as these funds <br />are prorated to the various municipalities by the State Water Control Board based on the <br />amount of funds available and the number of applications submitted." <br /> <br />On motion of Mr. King, the following resolution was adopted and by the following vote: <br /> <br />"A RESOLUTION REQUESTING A GRANT UNDER THE FEDERAL WATER POLLUTION ACT <br />FOR CONSTRUCTION OF SEWERAGE TREATMENT WORKS. <br /> <br /> WHEREAS, the Department of Interior is authorized under the Federal Water Pollution <br />Control Act to make grants'to municipalities for the construction of sewerage treatment works <br />and <br /> <br />WHEREAS, it is necessary for the City of Portsmouth to expand its sewerage system. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that: <br /> <br />1. A.P. Johnson, Jr., City Manager, is authorized to submit and sign an application, and <br />all subsequent documents, to the Department of Interior pursuant to the provisions of the <br />Federal Water Pollution Control Act requesting a grant to be used to construct an extension <br />of its sewerage system. <br />2. The pro3ect will consist of the construction of sanitary sewers along- Calvalier Boulevard" <br />and Greenwood Drive (S5), in the Elizabeth Acres and Mayflower park Areas (Si) and in the I <br />Manor View Area (S7), and the construction of pumping stations on Greenwood Drive ($8), Melvi~ <br />Drive (S2) and Chandler Harper Drive (S9), and such additional sewers and pumping stations ~ <br />as the City shall deem necessary or desirable. ~ <br /> <br />$. The City of Portsmouth will pay the remaining cost of the project if the request is approved. <br /> <br />4. The City of Portsmouth will provide proper and efficient operation and maintenance of 1 <br />the approved project after completion of construction thereof. <br /> <br />$. ~he City of Portsmouth will comply with the requirements of Executive Order 11246, pertains- <br />ina to equal employment opportunity in federally assisted construction contracts." <br /> <br /> Ayes: Holley, Johnson, King, Smith (II, Smith (R) Turner, Barnes <br /> Nays: ' ] <br /> <br /> 70-492 "I submit the attached resolution and recommend its adoption. This authorizes <br />the execution of a contract between the Seaboard Coast Line Railroad Company and the City <br />of Portsmouth for the purchase of property in the rear of the Municipal Building.
