November 24. 1970 <br /> <br />pursuant <br /> <br />affect the health or safety of persons residing or working in the neighborhood of the proposed <br />use, (2) will notbe detrimental to the public welfare or injurious to property or improvements <br />in the neighborhood, and (S) will be in accord with the purposes of said Zoning Ordinance. <br />That American Iron and Metal Company is hereby granted a use permit to operate a junk yard subject <br />to the following conditions: <br /> <br />(i) That open burning as prohibited by Section 4-4(b) of the Zoning Ordinance of the City <br /> of Portsmouth and Rule 4.1 of the Rules of the State Air Pollution Control Board not <br /> be conducted, <br /> <br /> {2) That the area described below be permanently enclosed by a fence or wall of 8 feet in <br /> height and of 90 percent solidity. <br /> <br /> (5) That gate openings in said fenice or wall be approved by the Traffic Engineer, <br /> <br /> (4) That parking be prohibited along such portions by the aforementioned fence line as are <br /> ~ppcified by the Traffic Hngineer, <br /> <br /> That no junk yard operations be conducted outside of the aforementioned fence line. <br /> <br /> That along any fence line abutting a residential zoning district said fence shall be set <br /> back 6 feet and screen planting consisting of Lombardy poplars and ligustrum be planted <br /> and maintained subject to annual inspection by the Parks Department as to adequacy and <br /> maintenance; i <br /> <br />to Section 4-2 of said Zoning Ordinance on the property described as follows: <br /> <br />Beginning at a point on the eastern inter~eetion of Turnpike Road and Phillips Avenue; thence <br />running northeasterly 150 feet along the southern right-of-way line of Turnpike Road to a <br />point; thence running southeasterly 100 feet to a point; thence running Kc~thwesterly 150 feet <br />to a point on the northern right-of-way line of Phillips Avenue; thence running northwesterly <br />100 feet along said northern right-of-way line of Phillips Avenue to the point of beginning. <br /> <br />Also beginning at a point on the southern right-of-way line of Turnpike Road 200 feet north- <br />east of the eastern intersection of Turnpike Road and Phillips Avenue; thence running north- <br />easterly 100 feet along said wouthern right-of-way line of Turnpike Road to a point; thence <br />running southeasterly 100 feet to a p6int; thence running northwesterly 100 feet to the point <br />of beginning." <br /> <br />Ayes: Holley, Johnson, King, Smith (I), Smith (R), Turner, Barnes <br />Na) s. Wilkins <br /> <br />Motion of Mr. Turner to ad6pt the resolution and to table the vacating of streets involved. <br /> <br />Motion of Mr. Johnson to amend the mption to include "to reserve the right to review and revise <br /> <br /> Vote being taken on Mr. Turner's ~otion, the following resolution, as amended, was adopted, and by the <br />following vote: <br /> <br /> "A RBSOLUTICIN GRANTING A USE PERMIT TO OPERATE A J~NK YARD ON THE NORTHERN SI1~E 8F T~RNPIKB <br /> ROAD NEaR ITS INTBRSBCTION WITH ROMANESQUE STREET. <br /> <br /> WHEREAS, B. M. and ~uth F. Schwetz and Howard B. Wilkins have made an application pursuant to S~ct~5~ <br />~-2 of the Zoning Ordinance of the City of Portsmouth, 1961w for the granting of a use permit as hereinafter <br />described; and <br /> <br /> WHERE.aS, the applicant and the Planning Director have done all things required to be done in connection <br />with said applicatio, and the Planning Commission has recommended the granting of said use permit, subject <br />to the conditions hereinafter stated. <br /> <br />NOW, TttBP~FORE, BE IT RESOLVED byy the Council of the City of Portsmouth, Virginia: <br /> <br />~lat the use for whioh the use permit hereinafter bescribed is sought (1) will not adversely affect <br />the health or safety of persons residing or workiqg in the neighborhood of the proposed use, <br />{2) will not be detrimental to the public welfare or injurious to property or improvements in <br />the neighborhood, and (S) will be in accord with the purposes of said Zoning Ordinance. <br /> <br />B.
