, January 26. 1971 <br /> <br /> The following reports from the City Manager wore read: <br /> 71-27 - "I submit the attached ordinance and recommend it be placed on first reading. This amends the <br />City Code pertaining to excavatioBs in City §treets. <br /> These amendments to the City Code are submitted to outline in more detail the procedures for obtaining <br />a permit for openings in the City streets. The ordinance is also more explicit in the r~uirements that must <br />bo mot when permits are issued for street openings. <br /> The present ordinance only referred to streets, where this amendment will include all public right-of-ways <br />There has also been included a provision for emergency street openings. ,The applicant will also be required <br />to present proof of insurance as a prerequisite to obtaining a permit. And there is also a provision whereby <br />the City Engineer can revoke a permit when the permitt?e fails to comply with the requirements of the ordinance <br /> _The rate sc~hedule has been adjusted to more realistically cover the cost to the City for these excavations <br />and an inspection fee of $5.00, plus 5¢ per square foot has been est~ublished." <br /> l~{otion of Mr. Smith (I) to suspend the rules to hear W. H. Blackwell, Jr., ~anager, Virginia Electric & <br />Power Company and Dave Stewart, ~4anager, Portsmouth Gas Corffpany was adopted. <br /> <br /> Mr. Blackwell and ~r. Stewart spokane-requesting a postponoment on first reading of ordinance until the <br /> February 9, 1971 meeting of City Council. <br /> <br /> Motion of Mr. Smith (I) to grant the request for deferment of consideration of the following ordinance <br /> to the February 9th meeting~ was adopted~ without dissenting vote: <br /> <br /> ";aY ORDINDaNCE TO A~,~ND THE CODE OF ~{E CITY OF PORTSMOI~H, VIRGINIA, 1961~ BY ~J~NDING SECTIONS <br /> 22-1~ 31-4, 51-5, 31-$3, 31-34, 51-35, 31-36, 31-37, 51-38, ;3.~D 31-39 THEREOF, ~aND.BY ADDING <br /> THERETO EIGHT NEW SECTIONS NUMBERED 31-3~.1, 31-37.1, 31-37.2, 31-57.3, 51-37.4, 31-37.5, <br /> 31~37.6, .~ND 31-38.1 PERTAINING TO ~E ISSUTU~CE OF PE~I~ITS TO EXCAVATE WITHIN THE CITY'S STREETS <br /> ;3~ D R! This prohibits <br />persons dressed as clowns, tigers, etc., from standing on the edge of streets waving at passing motorists <br />to attract attention for advertising purposes. <br /> <br /> This practice has the tendency to distract the motorist and rear,end collisions have resulted." <br /> On motion of Mr. Turner, the following ordinance was approved on first reading, and by the following vote: <br /> ";3I ORDIN~>~CE TO A~ND Th~ CODE OF THE CITY OF PORTSMOU%H, VIRGINIA, 1961, BY ~J)DING THERETO <br /> A NEW SECTION NL%~BERED 31-52.1, PROHIBITING LIVE ADVERTISING WITHIN AND ADJACSNT TO STREETS <br /> .A~D HI ~HWAYS." <br /> <br />AYes: Johnson, King, Smith (R), Turner, Barnes <br />Nays: Holley, Smith <br /> <br /> 71-29 - "I submit the attached ordinance and recommend it be placed on first reading. This appropriates <br />$15,000 for changes ~ocessary at the Civic Center, and also improvements to tho Council Chamber~ <br /> <br /> The changes at the Civic Center were necessary when an additional judge was employed. This also covers <br />the furnishings of the new judge's chambers." <br /> <br /> On motion of Mr. King, the following ordinance was ~pproved on first reading a~d by the following <br />vote: <br /> <br />"AN ORDINANCE TO APPRPRIATE $13,000.00 FROM THE GENERAL CAPITAL IMPROVEmeNT FUND FOR THE RENOVA- <br />TION ~D FU~4ISHING OF THE CIVIC CENTER." <br /> <br />Ayes: Holley, Johnson, King, Smith (I), Smith (R), Turner, Barnes <br />Nays: None <br /> <br /> 71-30 - "I submit the attached ordi-nance and recommend it be placed on first reading. This appropriates <br />$1,400 for the purchase of books for the Circuit Court.~- <br /> <br /> The Judge of the Circu~ Court has advised that these books are necessary for tho operation of the Court." <br /> <br /> On motion of Mr. Smith (I), the following ordinance was approved on first reading and by the\following <br />vote: <br /> <br />"~N ORDINANCE TO APPROPRIATE $1,400.00 FROM THE GENERAL FUND FOR THE PURCHASE OF LAW' BOOKS <br />FOR THE CIRCUIT COURT OF THE CITY OF PORTSMOUTH." <br /> <br />Ayes: Holley, Johnson, King, Smith (I), Smith (R), Turner, Barnes <br />Nays: None <br /> <br /> 71-31 - "I submit the attached resolution and recommend its adoption.t This appoints five viewers for <br />the closing of a portion of Cambridge Avenue north Of Hartford Street. <br /> <br />This ia a paper street and the Planning Commission has recommended this closing." <br /> <br />On motion of Mr. Turner, the following resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION APPDINTING VIEWERS FOR CLOSING OF CAMBRIDGE AVENUE NORTH OF HARTFORD STPEET <br /> <br /> ~4HEREAS, Charles W. Rodgers and R. Earl Byrd have made application to vacate and close the hereinafter <br />described portion of a certain street and it appearing that notice of the application and request for the <br />appointment of viewers was duly posted on January 7, 1971, on the bulletin board of the Court of Hustings <br /> <br /> <br />
