Holley~and Smith(I)-negative. <br /> <br /> Mr. Johnson requested that the following statement be included in the minutes - he had been assisting <br />Rev. Slaterb~ck, acting as a real estate agent in compiling an area bounded by Third and Fourth Streets, but <br />that he had resigned this commitment and all of his material in this connection is to be turned over to Rev. <br />Slaterbeck - therefore he ~eels free to discuss and vote on this issue. <br /> <br /> The following letter from the Board of D~rectors of Wesley Center was read: <br /> <br /> "The Board of Directors of ~e Wesley Community and Child Service Center; Inc. at its meeting of January <br />11, 1971 unanimously endorsed the modified industrial zoning proposed by the Planning Commission relative to <br />Southside. <br /> <br /> We urge adoption of the Planning Co~ission's proposal as being in the best interests of both the indust- <br />rial needs of Southside and the residents. <br /> <br /> We oppose the zoning petitioned by council which delineates a larger heavy industrial area without a buffe <br />betwee~ ~t ~d res~de~t~a~ areas~" <br /> <br />Use Permit 71-1 - Petition of Robert E. DeLoatch <br /> <br />No one spoke. <br /> <br />On motion of Mr. Smith (R) the following resolution was adopted~ and by {he following vote: <br /> <br />"A RESOLL?ION GRANTING A USE PERMIT FOR THE OPERATION OF A CONVALESCENT AND NURSING HONE <br />ON MADISON STREET NEAR ITS INTEP~$ECFION WITH SIXTH STREET <br /> <br /> WHEREAS, Robert E. Deloatch has made application pursuant to Section 4-2 of the Zoning Ordinance <br />of the City of Portsmouth, 1961, for the granting of a use permit as hereinafter described; and <br /> <br /> ~CqEREAS, the applicant and the Blanning Director have done all things required to be done in connection <br />with said application, and t~e Planning Commission has recommended the granting of said use permit, subject <br />to the conditions hereinafter stated. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> A. That the use for which the use permit hereinafter described is sought (1) will not adversely affect <br />the health or safety of persons residing or working in the neighborhood of the proposed use, (2) will not be <br />detrimental to the public welfare or injurious to property or improvements in the neighborhood, and (S) will <br />be in accord with the purposes of said Zoning 0rdi~ance. <br /> <br /> B. That Robert E. Deloatch is hereby granted a use oermit subject to site plan restrictions, pursuant <br />to Section 4-2 of said Zoning Ordinance for the operation*of a Convalescent and Nursing Home located on the <br />property described as follows: <br /> <br />Beginning at a point on the northwestern ri~nt-of-way line of Madison Street approximately 230 feet <br />southwesterly of the northwestern corner of Fifth and Madison Streets; thence running southwesterly <br />along said northwestern right-of-way line 45 feet more or less to a point; thence running north- <br />westerly 121 feet more or less to a point; thence running northeasterly 45 feet more or less to a <br />point; thence running southeasterly 121 feet more or less to the point of beginning." <br /> <br />~ves: Holley, Johnson, King, Smith (I), Smith (R), Turner, Barnes <br />Nays: None <br /> <br />PrOposed Zoning Ordinance Amendments: <br /> <br />"PROPOSED AMHNDMENrF TO SECTION 4-5 OF THE ,ZONING ORDINANCE OF THE CITY OF PORTSMOUTH TO ADD CERTAIN <br />TYPES OF DRY CLE~aWING FACILITIES: <br /> <br /> Section 4-5 Commercial C-1 District Uses" <br /> <br />On motion of Mr. King, the followSng ordinance was approved 'on first reading, and by the following vote: <br /> <br />"N~ ORDINANCE TO A~ND SECTIDN 4-5 0F THE ZONING ORDINANCE OF THE CITY OF PORTSMOUTH, 1961, <br />PERTAINING TO DRY CLEANING PICK-UP STATIONS." <br /> <br />Ayes: Nolley, Johnson, King, Smith ('I), Smith (R), Turner, Bamles <br />Nays. None <br /> <br />"PROPOSED ;¢~NDS~NT TO ARTICLE 9 OF THE ZONING ORDINANCE OF THE CITY OF PORTSMOUTH CONCEPNING THE <br />HISTORIC DISTRICT." <br /> <br />No action was taken on the proposed amendment since the necessary map was not available. <br /> <br />Motion of Mr. Smith [I) to refer back to the Planning Commission, was adopted without dissenting vote. <br /> <br /> <br />
