859 <br /> <br />,Tn~ g, 1971 <br /> <br /> On motion of Mr. Turner and seconded by Mr. Raymond Smith, the following ordinance was <br />approved on f~rst reading by t~e foilpw~ng vote~ <br /> <br />'AN ORDINANCE TO AMEND THE CODE OF <br />BY AMENDING SECTION 18-14 THEREOF <br />FROM CERTAIN CITY STREETS." <br /> <br />THE CITY OF PORTSMOUTH, VIRGINIA, 1961, <br />PERTAINING TO THE PROHIBITION OF TRUCKS <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> 71-254 -,,"I submit the attached resolution and recommend their adoption. The first <br />resolution authorizes the signing of a contract by the City of Suffolk and the City of <br />Portsmouth for the fur~ishing of water to the City of Suffolk. The second resolution <br />authorizes the signing of a contract for office space for the Water Department in the <br />Suffolk Municipal Building. In lieu of rent for this office space, the City will collect <br />the sewerage disposal fees for the City of Suffolk. <br /> <br /> The water contract is for a period of thrity (S0) years and under the contract t~e City <br />of Portsmouth Will sell water to the residents of Suffolk at'the same rate as sold to the <br />citizens of Portsmouth. The City will Lay to the City of Suffolk 10% of the revenue col- <br />lected on the sale of water within the City limits of Suffolk. In return, Suffolk will not <br />tax any of the properties of the Water Department within the City of Suffolk. <br /> <br /> The contract for the office space and collection of sewerage fees by the Water Depart- <br />men~ supersedes a contract now in effect which related to our previous water contract. <br /> <br /> The signing of the two contracts will also agree to the dismissal of the court proceed- <br />ing now pending in the Circuit Court of the City of Suffolk wherein Suffolk and others are <br />complainants and Portsmouth is the defendant." <br /> <br /> On motion of-Mr. Turner and seconded!by Mr; King,Ythe following resolution was adopted, <br />and by the following vote: <br /> <br />"RES©LUTION AUTHORIZING EXECUTION OF WATER SERVICE AGREEMENT WITH THE CITY <br />OF SUFFOLK <br /> <br /> BE IT RESOLVED BY THE COUNCIL ~f the City of Portsmouth, Virginia, that the City <br />Manager is hereby authorized and directed to sign and.acknowledge in.the name and on behalf <br />of the City of Portsmouth that certain agreement presented at this meeting between the City <br />of Portsmouth-and-the-City~af Suffolk, dated the 1st day of May, 1971, whereby the parties <br />thereto agree as to the furnishing of water by the City of'Portsmouth to the City of Suffolk <br />and-its inhabitants during the:term amd on.'and subject to the terms, conditions and provisior <br />as set forth in.the said3agreement; and the:~City CleVis hereby authorized and directed to a <br />affix the corporate seal of the City of Portsmouth to the said agreement and duly attest the <br /> <br /> Ayes: Holley, Johnson, King, Irvin~ Smith, Raymond Smith, Turner, BArnes <br /> Nays: None <br /> <br /> On motion of Mr. Raymond Smith and seconded by Mr. ~ohnson, the following resolution <br />was adopted, and by the following vote: <br /> <br />"RESOLUTION AUTHORIZING EXECUTION OF OFFICE AGREEMENT WITH THE CITY OF SUFFOLK <br /> <br /> BE IT RESOLVED:BY THE COUNCIE of the City of Portsmouth,:Virginia, that the City Managez <br />is hereby authorized and directed to sign in the name and on behalf of the City of Portsmouth <br />that certain agreement presented at this meeting between the City of $~ffolk and the City of <br />Portsmouth, '.&ated-the 2~'d'day of May,~,1971, wkereby:;the City Cf Suffolk agrees to furnish <br />to the City of Portsmouth office space in the Municipal Center building for use by the Depart <br />ment of Public Utilities of the City of Portsmouth and the City of Portsmouth agrees to act <br />as the agent of t~e City of Suffolk and, through its Departme~t'of Pub:lic Utilities, compute, <br />bill,collect and pay oyez to the Cif.y of Suffolk sewage &is~psal service charges imposed by <br />the City of Suffolk during the term and in accordance with the provisions as set forth in <br />sa~d agreement; and th'e.City Clerk is hereby authorized and directed to affix the corpprate <br />seal of the City of Portsmouth to said agreement and uly attest the same." <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> 71-255 <br />Company and <br />sign. This <br /> <br /> "I submit the attached agreement between the Virginia Electric and Power <br />the City of Portsmouth and recommend'the proper City officials be authorized to <br />covers the rates the City will be charged for municipal electrical service. <br /> <br /> The present contract will expire J~ne 20, 1971 and thi:s agreemeat Will extend this'for <br />an additional two years at the present r~tes now in effect." <br /> <br /> On motion of Mr. King and seconde~ by Mr. Raymond Smith, the proper~City officials be <br />authorized to th'e sign the agreemen't between the Virginia Electric and Power Company and <br />the Cily of Portsmouth, was adopted, and by the following vote: <br /> <br />Ayes: Holley, JOhnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: ~one <br /> <br /> 81-256 "I submit the attached agreements with the Virginia Electric and Power Company <br />and recommend the proper City officials be authorized to sign.
