S. That the Council is of the opinion that there exists in the City an adequate amount <br />of decent, safe and sanitary housing which is available to persons displaced as a result <br />of the concentrated code enforcement and public improyements programs at prices which are <br />within their financial means and which are not generally less desirable in regard to public <br />utilities and public and commercial facilities than the dwellings of persons that may be <br />displaced; and it is the sense of the Council that such displaced persons, if any, will <br />be relocated in accordance with applicable regulations of the Department of housing and <br />Urban Development. <br /> <br /> 5. That the United States of America and the Secretary of the Department Of Housing <br />and Urban Development be and they are hereby assured that the City of Portsmouth will, <br />insofar as it may legally do so, comply with all regulations of the Department of Housing <br />and Urban Development effectuating Title VI of the Civil Rights Act of <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> 71-406 - "I submit the attached letter from the City Assessor and recommend that the <br />refund be granted. 'This is an erroneous assessment on property located at 5001 Garner <br />AVenue. It covers the years 1969-70 and 1970-71. The amount is $36.00." <br /> <br /> On motion of Mr. Irvine S~ith and seconded by Mr. Turner, recommendation b~ the City <br />Manager was adopted by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, RaymOnd Smith, Turner, Barnes <br />Nays: None <br /> <br /> An amendment to the motion made by Mr. Holley and seconded by Mr. Turner to include <br />interest with the refund was defeated by a vote of: <br /> <br />Ayes: Holley and Turner <br />Nays: Johnson, King, Irvine Smith, Raymond Smith, Barnes <br /> <br /> 71-407 - "I submit the attached resolution and recommend its adoption. This is Amend- <br />ment No. 5 to the Fort Nelson Place Urban Renewal Project, VA R-6. The resolution has <br />been requested by the Portsmouth Redevelopment and Housing Authority in order that the <br />psychiatric hospital can be constructed on the site with the nursing home located at Erring- <br />ham Street and Crawford Parkway." <br /> <br /> On motion of Mr. King and se=Qnded by Mr. Irvine Smith, the following resolution as <br />recommended by the City Manager was adopted, and by the foltowihg vote: <br /> <br />"RESOLUTION OF THE COUNCIL OF THE <br />THE REDEVELOPMENT PLAN AS AMENDED <br />PROJECT, VA R-6. <br /> <br />CITY OF PORTSMOUTH, <br />BY AMENDMENT NO. S, <br /> <br />VIRGINIA, APPROVING <br />FORT NELSON PLACE ~ <br /> <br /> WHEREAS, by resolution adopted December 3, 1959, and amended by Amendment No. 4, dated <br />November 25, 1965, the Council of the City of Portsmouth approved a Redevelopment Plan <br />for the Fort Nelson Place Project, designated as Project VA R-6; and <br /> <br /> WHEREAS, in accordance with Section F of said Plan, it so provides that said Redevelop~ <br />merit Plan may be amended by the Portsmouth Redevelopment and Housing Authority with the <br />consent of the City Council; and <br /> <br /> WHEREAS, <br />of Project No. <br />Plan; and <br /> <br />the PortsmoUth Redevelopment and Housing Authority in undertaking the execUtion <br />VA R-6 has found it necessary to make minor changes to said Redevelopment' <br /> <br /> WHEREAS, the Portsmouth Redevelopment and Housing Authority has approved the changes <br />to the Redevelopment Plan by resolution which Plan dated August 27, 1971, together with <br />said resolution has beenreferred to City Council for review and approval and the City <br />Council has duly considered said Redevelopment Plan; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORTSMOUTH, VIRGINIA: <br /> <br /> 1. That said Redevelopment Plan, as amended, dated September, 1971, for the Project <br />aforementioned, having been duly reviewed and copsidered is hereby approved. <br /> <br /> 2.
