<br /> 71-405 "I submit the attached resolution and recommend its adoption. This authorizes
<br />submission of an application for federal funds to execute a federally-assisted code enforce-
<br />ment program. This program will cover most areas in North and South Mount Hermon and all
<br />of Park View which is not included in conservation projects being conducted under the supervision
<br />of Portsmouth Redevelopment and Housing Authority. For this program, the City is the appli-
<br />cant for a federal grant. The work is to be conducted under the supervision of City Depart-
<br />ments.
<br />
<br /> The federally-assisted code enforcement program must be completed within three years
<br />after contracts are signed. The program is financed with 2/3 federal funds and 1/5 local
<br />funds. It will be necessary for the City to spend approximately $100,000 in underground work
<br />which is necessary for the execution of this project. This money is not reimbursable to the
<br />City as this work does not qualify for allowable public improvement costs. In addition, approxi-
<br />mately $800,000 must be spent by the City for street improvements, curbs and gutters, sidewalks,
<br />lighting and catch basins allowed in conjunction with the curb and gutter and storm drain
<br />system. The total cost of this project is estimated to be $2,648,969.75. The total federal
<br />grant requested is $2,069,990.84. The City's 1/$ cost which will be spent in public improvemm~ts
<br />will also cover the City's share of relocation payments after July 1, 1972.

<br /> The Minimum Housing Code for the City of Portsmouth will be the applicable code for thisi
<br />project. The City must maintain its normal level of code enforcement in the remainder of
<br />the City during execution of a federally-assisted code project."

<br /> On motion of Mr. Turner, and seconded by Mr. Raymond Smith, the following resolution was
<br /> adopted, and by the following vote:
<br />
<br /> "A RESOLUTION TO AUTHORIZE AND DIRECT THE CITY MANAGER, FOR AND ON BEHALF OF
<br /> THE CITY OF PORTSMOUTH, TO FILE AN APPLICATION WITH THE DEPARTMENT OF HOUSING
<br /> AND URBAN DEVELOPMENT FOR FUNDS TO DEFRAY A PORTION OF THE COST OF INSTITUTING
<br /> AACONCENTRATED PROGRAM ENFORCING THE PROVISIONS OF THE CITY CODE, AND FOR THE
<br /> CONSTRUCTION OF CERTAIN IMPROVEMENTS IN THE MOUNT HERMON AND PARK VIEW AREAS
<br /> OF THE CITY OF PORTSMOUTH.

<br /> WHEREAS, Section 117 of the Housing Act of 1949, as amended, authorized the Secretary
<br />of the Department of Housing and Urban Development to make grants to municipalities to assist
<br />them in conducting concentrated programs enforcing certain provisions of local codes and
<br />for the construction of certain public improvements in deteriorated or deteriorating areas
<br />in which such enforcement, together with such public improvements to be provided by the City,
<br />may be expected to arrest the deterioration of such areas; and
<br />
<br /> WHEREAS, it has been represented to the Council, and the Council finds that there exists
<br />in the Mount Hermon and Park View areas of the City of Portsmouth certain deteriorated or
<br />deteriorating areas for which such a program may be expected to arrest the deterioration
<br />of these areas; and
<br />
<br /> WHEREAS, Section 117 of the Housing Act of 1949 as amended, imposes certain obligations
<br />upon the City of Portsmouth to assure that any persons who may be displaced as a result of
<br />the concentrated code enforcement and public improvements programs are provided decent, safe
<br />and sanitary housing; and
<br />
<br /> WHEREAS, the Portsmouth Redevelopment and Housing Authority has assured the Council
<br />of the City of Portsmouth that any persons who may be displaced as a result of the concen-
<br />trated code enforcement and public improvements programs will be relocated into decent, s~fe
<br />and sanitary housing in accordance with the regulations of the Department of Housing and
<br />Urban Development; and
<br />
<br /> WHEREAS, Title VI of the Civil Rights Act of 1964 and the regulations of the Department
<br />of Housing and. Urban Development provide that no person shall, on the grounds of race, color
<br />or national origin be excluded from participating in, be denied the benefits of er be subjecte
<br />to discrimination in the undertaking and carrying out of any program or activity receiving
<br />federal funds under Title I of the Housing Act of 1949, as amended;
<br />
<br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PORTSMOUTH, VIRGINIA:
<br />
<br /> 1. That the City Manager be and is hereby directed, for and on behalf of the City of I
<br />Portsmouth, to file an application with the Department of Housing and Urban Development for
<br />funds to defray a portion of the cost of instituting a concentrated program enforcing the
<br />provisions of the City Code and for the construction of certain public improvements in the ~
<br />Mount Hermon and Park View areas of the City of Portsmouth as set forth in Section 117 of
<br />the Housing Act of 1949, as amended; said funds shall represent two-thirds of the cost of
<br />the program, which cost is estimated to be $2,648,969.73.

<br /> 2. That the City Manager is further authorized and directed to provide such information
<br />and furnish such documents as may be required by the Department of Housing and Urban Develop~
<br />ment, to execute such contract or contracts as may be ne'cessary for the grant applied for,
<br />and to otherwise act as the authorized representative of the City of Portsmouth in accomplish-
<br />ing the said program.

<br /> 3. That during the period of the grant for code enforcement, the City will maintain
<br />a level of expenditures for code enforcement activities exclusive of expenditures in any
<br />federally assisted code enforcement or Title I urban renewal project areas that is not less
<br />than the average yearly expenditure for such activities throughout the City for the two full
<br />fiscal years immediately preceding the filing of such' application.
<br />
<br /> 4. That the City will maintain a program for and will provide in a timely manner all
<br />necessary public improvements for the code enforcement areas.
