<br />This adds a new section to the City Code numbered 19-19.1, making it unlawful to maintain
<br />or frequent a house or other place for the purpose of keeping or dispemsing narcotics,
<br />drugs or other controlled paraphernalia, illegally.
<br />
<br /> In June of 1970, the State adopted "The Drug Control Act." This act repealed previous
<br />laws pertaining to narcotics and drugs and set up new controls and penalties. A section
<br />dealing with "Maintaining Common Nuisances where Narcotic Addicts Frequent" was repealed
<br />and was not included in the new 1970 act. It is believed that this was left out by
<br />mistake.
<br />
<br /> In the past year and a half, the City's Narcotic Squad has Used Section 19~19.1 of
<br />the City Code, "Maintaining a Disorderly House," on places where narcotic addicts have fre-
<br />quented. The Court not of record has convicted in these cases. Recently, the City had
<br />a case involving possession of narcotics, possession of controlled paraphernalia, and Sections
<br />19-19.1 and 19-19.2 were used in the arrest. This Was convicted in the lower cOurt and
<br />was appealed. The case was dismissed in the Court of Record on the basis that Sections
<br />19-19.1 and 19~19.2 do not cover narcotic situations -- they only apply to liquor, gambling
<br />and disorderly conduct.

<br /> This proposed section wilt help in apprehending and identifying persons who are closely
<br />associated with narcotics traffic and allow the use or distribution of drugs on their proper}y
<br />or place of business."

<br />wastewater treatment units plus site requirements. Preliminary layouts for sludge incinera~:
<br />tion facilities plus estimates of cost will also be included. Investigation will be made
<br />for providing alternate grit removal methods as well as preliminary plans showing the most
<br />feasible alternatives."

<br /> 71-53S "In accordance with action taken~by the City Council on August 24, directing
<br />that the City Manager's Office and the Portsmouth Redevelopment and Housing Authority submit
<br />a plan of action for the Park View Conservation Project, and outlining how and when action
<br />will be taken, I respectfully submit the following report in two parts.
<br />
<br /> The first part outlines the.actions for which the City of Portsmouth is responsible.
<br />The second part deals with responsibilities of PRHA.
<br />
<br /> Net cost of the project submitted in June, 1968 to the Department of Housing and Urban
<br />Development was estimated at $2~7 million~ The City's share of this cost was estimated
<br />at $908,02S, of Which $68S,968 is to be in improvements and $222,0S7 in cash payments.
<br />
<br /> The City paid $100,000 i~ $S0,000 installments on January IS, 1970, and January 8,
<br />1971~ leaving a balance of $122,0S7 to be paid by January; 1973.
<br />
<br /> Our cash payments represent the difference between the cost of improvements we are
<br />to provide and the total one-third participation costs required under Federal grant regulations.
<br />
<br /> The improvements the City is required to provide include roadway demolition, storm
<br />drains, sanitary sewers, water lines, new roads and walkways, resurfacing of some streets,
<br />and recreational facilities.
<br />
<br /> The City:Engineer's Office points out two important considerations as to scheduling
<br /> and potential costs. The work schedule is based on preliminary plans and is subject to
<br /> adjustment if more detailed study reveal's conditions not shown in the preliminary maps.
