January 26, 1999 <br /> <br />(b) <br /> <br />Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) <br /> <br />Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br />(d) <br /> <br />Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient <br />traffic movement; and <br /> <br />(e) <br /> <br />Will be in accordance with the purposes of the City of Portsmouth <br />Zoning Ordinance. <br /> <br /> 2. That Sandra Pinnock is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a <br />child day care facility on property located at 1220 Cavalier Boulevard, and being <br />more particularly described as: <br /> <br />UP-93-03 (M) <br /> <br /> Beginning on the west right-of way of Cavalier Boulevard <br />170' more or less north from its intersection with the north right-of- <br />way Tazewell Street; thence west 150' to a point; thence north 150' <br />to a point; thence east 150' to the west right-of-way of Cavalier <br />Boulevard; thence south along said right-of-way 150' to the point of <br />beginning. <br /> <br /> 3. That this amended use permit is approved subject to the following <br />conditions: <br /> <br />(a) <br /> <br />Occupancy of the facility shall be limited to no more than one hundred <br />children. <br /> <br />(b) <br /> <br />The facility shall comply with the submitted site plan and floor plan, <br />identified respectively as Exhibits A and B, attached hereto and made a <br />part hereof. <br /> <br />(c) The applicant shall maintain twelve paved, on-site parking spaces. <br /> <br />(d) The applicant shall maintain six paved, off-site parking spaces. <br /> <br />(e) <br /> <br />The facility shall submit to all required inspections by the Fire <br />Department, the Public Health Department and the Building Official and <br />shall correct any noted deficiencies. <br /> <br />(f) <br /> <br />The facility shall comply with all applicable federal, state, and local <br />codes, ordinances and regulations of federal, state and local <br />governments, and shall obtain and shall maintain in effect all necessary <br />licenses and permits. <br /> <br />(g) <br /> <br />All taxes and fees on the subject property and the operation shall be <br />paid when due. <br /> <br /> 4.
