January 26, 1999 (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Sandra Pinnock is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a child day care facility on property located at 1220 Cavalier Boulevard, and being more particularly described as: UP-93-03 (M) Beginning on the west right-of way of Cavalier Boulevard 170' more or less north from its intersection with the north right-of- way Tazewell Street; thence west 150' to a point; thence north 150' to a point; thence east 150' to the west right-of-way of Cavalier Boulevard; thence south along said right-of-way 150' to the point of beginning. 3. That this amended use permit is approved subject to the following conditions: (a) Occupancy of the facility shall be limited to no more than one hundred children. (b) The facility shall comply with the submitted site plan and floor plan, identified respectively as Exhibits A and B, attached hereto and made a part hereof. (c) The applicant shall maintain twelve paved, on-site parking spaces. (d) The applicant shall maintain six paved, off-site parking spaces. (e) The facility shall submit to all required inspections by the Fire Department, the Public Health Department and the Building Official and shall correct any noted deficiencies. (f) The facility shall comply with all applicable federal, state, and local codes, ordinances and regulations of federal, state and local governments, and shall obtain and shall maintain in effect all necessary licenses and permits. (g) All taxes and fees on the subject property and the operation shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council."
