January 26, 1999 <br /> <br /> At a Regular Meeting of the City Council on Tuesday, January 26, 1999, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, P. <br />Ward Robinett, Jr., J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., City Manager Ronald W. Massie, City Attorney G. Timothy Oksman. <br /> <br /> Vice Mayor Bernard D. Griffin, Sr. opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to approve the minutes <br />of a Called Meeting on January 12, 1999, and a Regular Meeting on January 12, <br />1999, and was adopted by unanimous vote. <br /> <br />99-14 - Presentations: <br /> <br />Proclamation presented to Hugh Copeland for "Hurrah Players Day." <br /> <br />Presentation of special lapel pins to newly appointed members of the Youth <br />Advisory Commission. <br /> <br />- Public Hearing - <br /> <br />99-15 - Public Hearing on proposed change in designation of voting place for <br />Precinct 14 FROM the Christian Antioch Church, 2200 Palmer Street, Portsmouth, <br />Virginia to the Emily Spong Elementary School, 2200 Piedmont Avenue, Portsmouth, <br />Virginia. <br /> <br />1. Dianna Dirkx, 724 Cambridge Avenue, questioned whether the Emily Spong <br />would be opened to the children on voting day and various safety issues. <br /> <br />- Unfinished Business- <br /> <br />99-04 - Use Permit: <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Griffin, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />99-04 (a): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO SANDRA PINNOCK FOR THE <br />OPERATION OF A CHILD DAY CARE FACILITY AT 1220 CAVALIER BOULEVARD. <br /> <br /> WHEREAS, Sandra Pinnock has made application pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (1988)for the modification of the <br />conditions of a use permit originally granted to her by resolution of the City Council <br />dated May 25, 1993, to operate a child day care facility at 1220 Cavalier Boulevard, <br />Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting the <br />application for an amended use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br />(a) <br /> <br />Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> <br />
