51 2 January. 26. 1999 At a Called Meeting of the City Council on Tuesday, January 26, 1999, there were present: *Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C.. Pitts, P. Ward RObinett, Jr., J. Thomas Benn I11, William E. Moody, Jr., Charles B. Whitehurst, Sr., City Manager Ronaid W. Massie, City Attorney G. Timothy Oksman. 99 - 12 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Council Chamber, 801 Crewford Street, 6th floor, 5:00 p.m., Tuesday, January 26, 1999, for the purpose of a Public Work Session. In addition, you may consider a motion to go into an Executive Session. By order of the Mayor." 99 - 13 - The following items were discussed in Public Work Session: 1. Commission of Architectural Review Appeal for 126 Linden Avenue Motion by Mr. Whitehurst, and seconded by Mr. Pitts, for postponement of consideration of the appeal request until February 23, 1999 for the purpose of authenticating correspondence received from the Department of Housing and Community Development, and was adopted by a vote of 6-1 (Robinett). 2. City Assessor's Annual Report 3. City Flag Motion by Mr. Griffin, and seconded by Mr. Robinett, to go into Executive Session pursuant to provisions of Section 2.1-344 of the Code of Virginia, to discuss or consider the folloWing: (1) Discussion or consideration of the condition, acquisition or use of real property for a public purpose, or the disposition of publicly held property, as permitted by Subsection (A)(3). The subject real estate is in the mid-city area of Portsmouth. (2) Discussion of appointments by Council to committees, boards, or commissions, as permitted by Subsection (A)(1); Motion was adopted by unanimous vote. Motion by Mr. Robinett, and seconded by Mr. Pitts, pursuant to Section 2.1- 344.1 of the Code of Virginia certifying that to the best of the Council Member's knowledge during the immediately preceding Executive Session of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Executive Session was convened, were heard, discussed or considered in the meeting by the City Council.
