51 2 January. 26. 1999 <br /> <br /> At a Called Meeting of the City Council on Tuesday, January 26, 1999, there <br /> were present: <br /> <br />*Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C.. Pitts, P. <br />Ward RObinett, Jr., J. Thomas Benn I11, William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., City Manager Ronaid W. Massie, City Attorney G. Timothy Oksman. <br /> <br />99 - 12 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City <br />Council Chamber, 801 Crewford Street, 6th floor, 5:00 p.m., Tuesday, January 26, <br />1999, for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into an Executive Session. <br /> <br />By order of the Mayor." <br /> <br />99 - 13 - The following items were discussed in Public Work Session: <br /> <br />1. Commission of Architectural Review Appeal for 126 Linden Avenue <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Pitts, for postponement of <br />consideration of the appeal request until February 23, 1999 for the purpose of <br />authenticating correspondence received from the Department of Housing and <br />Community Development, and was adopted by a vote of 6-1 (Robinett). <br /> <br />2. City Assessor's Annual Report <br />3. City Flag <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Robinett, to go into Executive <br />Session pursuant to provisions of Section 2.1-344 of the Code of Virginia, to discuss <br />or consider the folloWing: <br /> <br />(1) Discussion or consideration of the condition, acquisition or use of real property for <br /> a public purpose, or the disposition of publicly held property, as permitted by <br /> Subsection (A)(3). The subject real estate is in the mid-city area of Portsmouth. <br /> <br />(2) Discussion of appointments by Council to committees, boards, or commissions, <br /> as permitted by Subsection (A)(1); <br /> <br />Motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Pitts, pursuant to Section 2.1- <br />344.1 of the Code of Virginia certifying that to the best of the Council Member's <br />knowledge during the immediately preceding Executive Session of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion by <br /> which the Executive Session was convened, were heard, discussed or <br /> considered in the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br />On motion, meeting adjourned. <br /> <br />APPROVED - <br /> <br />Dr. J{~m~s W.
