D~r~mh~ 71 lqT1 <br /> <br /> "RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION oF COLUMBIA STREET. <br /> <br /> WHEREAS, Lewis Chevrolet Corporation has made application to vacate and close the <br />hereinafter described portion of a certain street and it appearing that notice of the appli- <br />cation and request for the appointment of viewers was duly posted on December 9, 1971, <br />on the bulletin board of the Court of HuStings for the City of Portsmouth, on the bulletin <br />board of the Circuit Court of the City of portsmouth, and on the bulletin board of the <br />Municipal Court of the City of Portsmouth. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that Frank N. Bilisoly, Louis J. Leitner, L. A. Clark, Zalmon I. Blachman and F. J. Bergeron <br />be appointed viewers to view the hereinafter described portion of such street and report <br />to this Council in writing whether in their opinion, any and if any, what inconvenience <br />would result from vacating and closing the following: <br /> <br /> That portion Of Columbia Street which is bounded <br /> on the West by the Western right of way line of <br /> Columbia Street (formerly Eighth Avenue) and the <br /> Eastern boundary line of Lot 33 as shown on the <br /> Plat of Property of John J. Phillips, recorded in <br /> the Clerk's Office of the Court of Hustings for <br /> the City of Portsmouth, Virginia, in Map Book 2, <br /> page 41; and bounded on the East by the Eastern <br /> boundary line of Lot 71, as shown on said plat, <br /> if extended from its Southeastern corner South <br /> 55~ 30' East to the Southern right of way line ~ <br /> of Columbia Street." <br /> <br /> Ayes: Holley, Johnson, King, Raymond Smith, Turner, Barnes <br /> Nays: None <br /> <br /> 71-577 "Bids were opened on December 16, 1971 fpr the sale of six City-owned lots <br />in Pinners Point. One bid was received from Portsmouth Terminals, Inc. in the amount of <br />$10,000. It is their plan to construct a maintenance building on this property to service <br />the equipment used in the operation of the marine terminal. <br /> <br /> I recommend the property be sold to Portsmouth Terminals, Inc." <br /> <br /> On motion of Mr. <br />Portsmouth Terminals, <br /> <br />Ayes: <br />Nays: <br /> <br />Hotley, and seconded by Mr. Turner, the property to be sold to <br />Inc., was adopted by the roll, lng vote: <br /> <br />Holley, Johnson, King, Raymond Smith, Turner, Barnes <br />None <br /> <br />UNFINISHED BUSINESS <br /> <br /> 71-544 The following ordinance approved at the Public Hearing meeting, A~ld on <br />December 6, 1971, was taken up and re~d: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 71-33" <br /> <br /> On motion of Mr. King and seconded by Mr. Raymond Smith, the ordinance was adopted, <br />and by the following vote: <br /> <br />Ayes: Holley, Johnson, King, R~ymond Smith, Turner, Barnes <br />Nays: None <br /> <br />The following letter received from Director of Planning, was read: <br /> <br /> "At its regular monthly meeting on December 7, 1971, the City Planning Commission <br />received word that my communication of December 2, 1'971 relative to a proposed amendment <br />of the Zoning Ordinance (see below) was returned for lack of a specific recommendation: <br /> <br />PROPOSED ZONING ORDINANCE AMENDMENT: Consideration will be given to a proposal of <br />the City Planning Commission that the Zoning Ordinance be amended by adding thereto <br />a new section pertaining to denial of rezoning petitions by the Planning Director: <br /> <br />S~ction 8-4.1 Petition Denial by Planning Director <br /> <br />No petition for a zoning change shall be accepted by the Planning Director <br />within one year of the final action by the City Council upon przor petition <br />of the same owner concerning a zoning change on substantially the same <br />parcel of land. <br /> <br /> Since this was initiated and is described as a proposal of the City Planning Commission <br />I failed to note the fact of a favorable recommendation. For this oversight, and the <br />resultant misunderstanding, you have my apology. The Planning Commission does recommend <br />that you consider this matter and would have you approve such an amendment to the Zoning <br />Ordinance." <br /> <br /> <br />
