January 9~ 19~3 <br /> <br />'~ RESOLUTION REQUESTING THE REPRESENTATIVES OF THECITY OF PORTSMOUTB IN THE <br /> GENERAL ASSEMBLY TO INTRODUCE AND VIGOROUSLY SUPPORT LEGISLATION DURING THE <br /> 1973 SESSION OF THE ASSEMBLY AMENDING SECTIONS 190 AND 192 OF THE APPROPRI- <br /> ATIONS ACT (CHAPTER 804 OF THE ACTSBY THE GENERAL ASSEMBLY 1972) TO PROVIDE <br /> THAT THE APPROPKIATIONS BYTHE COMMONWEALTH OF VIRGINIA FOR LOCAL HEALTH <br /> DISTRICTS SHALL BE ENCUMBERED AND TI/AT'SUCH APPROPRIATIONS SHALL NOT LAPSE <br /> AT THE END OF THE BIENNIUM FOR WHICHSAID APPROPRIATIONS ACT SHALL HAVE BEEN <br /> ADOPTED. <br /> <br /> ~HEREAS, SectiOns 190'and 192 of the State Appropriations Act of 1972 provide for <br />the reversion of ali unexpended balances at the end;of each~biennuml and <br /> WHEREAS, no provision is made for the encumbrance of funds for the payment for equipmen~ <br />that is ordered during one biennium and not delivered until the next biennum; and <br /> <br /> WHEREAS, payment for such equipment must be made from a budget that does not contain <br />an appropriatiOn'for-said equipment while the funds that were appropriated have reverted <br />to the State's General Fund. <br /> <br /> NOW, THEREFORE, Be it resolved by the Council of the City of Portsmouth that the repre~ <br />sentatives of the City of Portsmouth in the General Assembl~ be and are hereby requested <br />to introduce and vigorously support legislation during the 1973 session of the Assembly <br />amending Sections 190 and 192 of the Appropriations Act (Chapter 80'4 of the Acts of the <br />General Assembly 1972) to prOvide that the appropriations by the Commonwealth of Virginia <br />for local health districts shall be encumbered'and that such appropriations shall not lapse <br />or revert at theend of.the biennium for which'said Appropriations Act shall have been adopted." <br /> <br /> Ayes: Barly, Holley, Johnson, King, Smith, Wentz, Barnes <br /> Nays: None <br /> <br /> 75-10 - "I submit the attached agreements between the Norfolk and Western Railroad, <br />Seaboard Coast Line Railroad, and the City of Portsmouth. These allow the installation <br />of an eight-inch water main under the tracks near~agnolia, Nansemond, Virginia. <br /> <br /> The main is needed to complete the City'sobligation in the Norfolk Road Sanitary District <br />(Pierces Park Project) for water service. <br /> <br />I recommend the proper City officials be authorized to si~n." <br /> <br /> Motion of Mr. Early and seconded b~Mr. Johnson, to concur with the recommendation, was <br />adopted by the following vote: <br /> <br />Ayes: Early, Holley, Johnson, King. Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 73-11 - "I submit th? attached resolution and recommend its ~doption. This approves <br />and authorizes the execution of a revised cooveration agreement with the Portsmouth Redevelop- <br />ment an~ Housing Authority for the 01de To,ne Conservation Project. Va. R-49. <br /> <br /> These are financial, amendments.to allow the City to take advantage of additional non- <br />cash credits due to increased.construction costs. The original estimates for the non-cash <br />cost were approved in <br /> <br /> On motion of Mr. Smith and secondedby Mr. Johnson. the following resolution was adopte~, <br />and by the following vote: <br /> <br />"RESOLUTION OF THE COUNCILOF THE CITY OF PORTSMOUTH APPROVING AND AUTHORIZING <br />THE EXECUTOR OF A REVISED COOPERATION-AGREEMENT WiTH THE PORTSMOUTH REDEVELOP- <br />MENT AND HOUSING'AUTHORITY FOR THE OLDE TOWNE CONSERVATION PROJECT, VA. R-49. <br /> <br /> WHEREAS, under the provisions of Title I of the Housing Act of 1949 as amended, the <br />Secretary of Housing and Urban Development entered into a contract with the PortSmouth <br />Redevelopment and Housing Authority on Decemhbe 23, 1968~ to p~ovide' financial assistance <br />to the Authority for underta~ing.~rban renewal activities within the.Olde Towfie Conservation <br />Project, Va. R-49, as specified ~n. the document, entitled, "Conservation Plan for the Olde <br />Towne Conservation.Project, Va. R-49", which has been approved by both the Authority and the <br />City of Portsmouth; and ' <br /> <br /> WHERHAS, the Authority has applied for additional financial, assistance under said Act <br />in order to complete said project and proposes to enter lnto an amended contract with the <br />Department O~ Housing an~-Urban Development-for the undertaking of and fo~miking available <br />additional financiaI assistance for the Project; and <br /> <br /> WHEREAS, a revised Cooperation Agreement for the said project has. been prepared which <br />adjusts the obligation of the City tO accord with said amendatory application, which re- <br />vision has been carefully reviewed at this meeting; and <br /> <br /> Council is cognizant of the conditions that are imposed in the under- <br /> WHEREAS, the City <br />taking and carrying out of urban renewal projects with Federal financial assistance under <br />Title I, including those prohibiting discrimination because Of race, color, creed, or nation~ <br />al ~rigin; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth: <br /> <br /> <br />
