<br /> NO~, THEREFOREs BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />Frank N. Bilisoly, L. A. Clark, Louis J. Leitner, Zalmon I. Blachman and R. Irvine Smith,
<br />be appointed viewers to view the hereinafter described portion of such street and report to
<br />this Council in writing whether in their opinion any, and if any, what inconvenience would
<br />result from vacating and ~closing the following:

<br />That certain parcel of land situate in the City of Portsmouth, Virginia
<br />and comprisxng all of Seventh Street as shown on the plat of Churchland
<br />Land Company, duly recorded in Map Book 18, page 85, in the Clerk's Office
<br />of the Circuit Court of Chesapeake, Virginia which lies Nest of Tyre Neck
<br />Road." '

<br />Senate Bill 612 now under consideration by the General Assembly. This provides a
<br />moratorium to allow cities to continue to use the Southern Standard Building Code
<br />of the BOCA Building Code.

<br /> ~hile final decision has not been made by the State Housing Board as to which code will
<br />be adopted by the State of Virginia, we are requesting support of this bill should the Board
<br />adopt the BOCA Code. If the BOCA Code is adopted by the State Housing Board, it requires
<br />that it be effective September 1, 1973. This moratorium will allow cities to develop a more
<br />orderly transition from the Southern Standard Code to the BOCA Code."

<br />"A RESOLUTION REQUESTING THE R~PRESENTATIVES OF THE CITY OF PORTSMOUTH IN THE
<br />GENERAL ASSF31BLY TO VIGOROUSLY SUPPORT DURING T}~ 1973 SESSION OF THE ASSEMBLY,
<br />~E~A~ti':BI~[-~I~REglTING TO THE EFFECTIVE DATE OF THE UNIFORMSTATE WIDE
<br />BUILDING CODE AND A GRACE PERIOD FOR CERTAIN LOCAL BUILDING CODES IF IT APPEARS
<br />THAT NO' LEGISLATIVE ALTERNATIVE WHICE~OULD ALLOW CONTINUED INDEFINITE USE OF
<br />THE SOUTHERN STANDARD BUILDING CODE IS AVAILABLE.

<br /> ~HEREAS, the 1972 session of the General Assembly authorized the adoption of a
<br />wide building code to become effective no later than September 1. 1973; and.

<br /> lfltEREAS, the presently proposed--state wide building code is different from the one in
<br />force and effect in the City of Portsmouth: and
<br />
<br />adopte!,

<br /> WHEREAS, adoption of a completely different building code by September of this year
<br />would imnose a great hardship on the City Government of Portsmouth; and
<br />
<br /> ~dEREAS, House Bill 612 proposes to amend Section $6-101 of the Code of Virginia. 1950.
<br />in such a way as to allow a grace period of two years for localities who have codes differing
<br />from the proposed state wide building code; and
<br />
<br /> ~ltEREAS, it is the preference of the Council of the City of Portsmouth that the Southerr
<br />Standard Building Code be made an available alternative for localities by legislative means.
<br />
<br /> NO~. THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the representatives of the City of Portsmouth in the General Assembly be, and are hereby requ~
<br />to support Senate Bill 612 during the 1973 session of the General Assembly if it appears that
<br />no legislative alternative which would allow the continued indefinite use of the Southern
<br />Standard Building Code is available."

<br /> 73-27. "I submit the attached agreement between the Hampton Roads Sanitation District
<br />and the City of Portsmouth and recommend the proper City officials be authorized to sign.
<br />This covers the e~ten~ion of a sewer force main along River Shore. Road and Swannanoa Drive
<br />to serve new subdivisions in the Churchland area,
<br /> ~/hile this sewer extension is the responsibility 0f the Hampton Roads Sanitation DistriCt
<br />they have no funds available for this construction. The~Cit~ feels that it is essential to
<br />provide this interceptor sewer immediately. Therefore, it wxll be necessary to construct
<br />it with ~tility Fund money. This agreement provides for the reimbursement by Hampton Roads
<br />Sanitation District.

<br /> Under the terms of the agreement, the sewer line wi!! be built to conform
<br />for objectives of the Commission. Plans and specifications will be approved by
<br />before any work is begun. The City agrees that when notified by the Commission
<br />to pay the purchase price, the City will, within 60 days, convey the facilities
<br />sion.
