This <br />authorizes the City Manager to enter into an agreement with the Seaboard Coast Line Railr¢ <br />Company for the.installation and maintenance of a water line under the railroad tracks <br />that are near Algren in the City of Chesapeake. <br /> <br /> The City of Portsmouth desires this agreement in order that ~ater can be served in <br />this area." <br /> <br /> On motion of Mr. Smith and seconded by Mr. Wentz, the following resolution was <br />adopted, and by the following vote: <br /> <br />"ASREF~B~TI~M,RUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREt~4BNT WITH <br />THE SEABOARD COAST LINE RAILROAD COMPANY CONCERNING THE INSTALLATION AND <br />MAINTENANCE OM A COPPER PIPE UNDER THE PROPERTY OF THE RAILROAD COMPANY AT <br />OR NEAR ALGREN, VIRGINIA. <br /> <br /> WHEREAS, the Portsmouth Department of Public Utilities has made application to the <br />Seaboard Coast Line Railroad Company for permission to install a 3/4 inch copper water <br />line under the property of the railroad near Algren, Virginia; and <br /> <br /> WHEREAS, the Seaboard Coast Line Railroad Company requires a written agreement betwe~ <br />the railroad and the City of Portsmouth before allowing any such installation of pipes <br />under its property; and <br /> <br /> WHEREAS, the Seaboard Coast Line Railroad requires a resolution of the City Council <br />authorizing its City Manager to enter into a written agreement. <br /> <br /> NOW, THBREFOP~, BE IT RESOLVED by the Council of the City of PortsmOuth, Virginia, <br />in a regular meeting assembled that the City Manager of said City be, and he hereby ls, <br />authorized to enter into an agreement with the Seaboard Coast Line Railroad Company, and <br />to sign same on behalf of said City whereby said Railroad Company grants unto said City <br />the right or license to install and maintain, for the purpose of conducting water, a line <br />of 5/4 inch copper pipe across the right of way and under the main track of said Railroad <br />Company at or near Chesapeake (Algren), Virginia, as more particularly described in said <br />agreement, which agreement is dated June 1, 1975, a copy of which agreement is filed with <br />this City Council." <br /> <br />Ayes: Holley, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 75-$17 "I submit the~attached ordinance and recommend it be?placed on first <br />reading.
