-101' <br /> <br />August 14, 1975 <br /> <br /> 73-546 - "I submit the attached two ordinances and recommend they be placed on <br />first reading. One ordinance amends the Supplemental Retirement System and the other <br />amends the Fire and Police Retirement System to provide vesting rights to City employees. <br /> <br /> The ordinances provide that employees with ten years of service will have 50% vested <br />rights in retirement benefits. They shall also receive 5% for each additional year <br />up to twenty years of service. <br /> <br /> Employees under the Supplemental System who leave the employment of the City under <br />the vested interest rights cannot receive retirement benefits until age sixty-five. <br />Under the Fire and Police system, they must attain age sixty-two. <br /> <br /> This also amends the Supplemental System to prohibit membership to anyone employed <br />after age fifty-five." <br /> <br /> On motion of Mr. Smith and seconded by Mr. Johnson, the following ordinanc~ were <br />approved on first reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF~THE CITY OF PORTSMOUTH, VIRGINIA, <br />1961, BY AMENDING SECTIONS 26-20, 26-51, 26-32 and 26-34 THEREOF PER- <br />TAINING TO THE PORTSMOUTH SUPPLEMENTAL RETIREMENT SYSTEM." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br />~3~38RDtNANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />196r, BY AMENDING SECTIONS 26-65 and 26-?6 THEREOF PERTAINING TO THE <br />PORTSMOUTH FIRE AND POLICE RETIREMENT SYSTEM." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 73-547 "At the p~esehg time, the City is awaiting the receipt of a deed conveying <br />approximately one~nda~half acres of land owned by the Seaboard Coast Line Railroad. <br />The land is directly the rear of the present Municipal~Building. <br /> <br /> On August 1S, 1972, the Railroad Company, by indenture, granted to the Virginia <br />Department of Highways a righ~e~way and easement for construction purposes incident <br />to the Crawford Street Connector over a portion of the hereinabove mentioned parcel <br />of land. <br /> <br /> The Legal Department feels it is in the City's best interest to have the Railroad <br />Company assign its rights and interest in the said easement to the City of Portsmouth. <br />To accomplish this, I recommend that I be authorized to!sign an agreement of assignment <br />with the~Railroad Company." <br /> <br /> On motion of Mr. Smith and seconded by Mr. <br />a~epte, d~ ~ d ~.~th~-~llowzng vote. <br /> <br />Johnson, the following <br /> <br />~'e$o!dtien was <br /> <br />,,A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT <br />WITH THE SEABOARD COAST LINE RAILROAD COMPANY CONCE~RNING THE ASSIGNMENT <br />OF THE RAILROAD'S RIGHTS AND INTEREST TO A CERTAIN EASEMENT HELD BY THE <br />VIRGINIA DEPARTMENT OF HIGHWAYS WHICH SAID EASEMENT IS LOCATED WITHIN A CER- <br />TAIN TRACT OF LAND TO BE'CONVEYED TO THE CITY OF PORTSMOUTH BY THE SEABOARD <br />COAST LINE RAILROAD COMPANY. <br /> <br /> WHEREAS, the Seaboard Coast Line Railroad Company has agreed to deed a certain <br />tract of land consisting of 1.481 acres, more or less, to the City of Portsmouth; and <br /> <br /> I~EREAS, prior to said conveyance, the Railroad Company by indenture dated August <br />iS, 1972, granted to the Virginia Department of Highways of the Commonwealth of Virginia, <br />a right of way and easement for construction work purposes, incident to the construction <br />of the Crawford Street Connector, on and over a portion of said 1.481 acres of land; <br />and <br /> <br /> WHEREAS, the Railroad Company and the City of Portsmouth mutually desire that the <br />Railroad Company assign its rights and interest in said easement to the City of Portsmout <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />in a regular meeting assembled that the City Manager of said City be, and he hereby <br />is, authorized to enter into an agreement with the Seaboard Coast Line Railroad Company, <br />and to sign same on behalf of said City whereby said Railroad Company grants unto said <br />City its rights and interest in said easement as set forth in the hereinabove mentioned <br />agreement a copy of which agreement is f~led with this City Council." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentx, Barnes <br />Nays: None <br /> <br /> 7~-348 - "I submit the attached resolution and recommend its adoption. This agrees <br />to the City providing the right-of-way for the construction of the extension of Moorview <br />Avenue over the Seaboard Coast Line tracks. The City also agrees to maintain the street <br />as a public right-of-way. This crossing is necessary as the industrial land west of <br />the Greenwood Drive interchange, when built, will have no access. <br /> <br /> <br />
