It has been necessary to adjust the boundar~ <br />Yes of this land due to other construction in the area. The attorneys for the City <br />and the Authority have agreed that the best procedure will be for the City to deed the <br />land back to the Authority and the Authority will, in turn, give the City a corrected <br />deed. This resolution will accomplish this." <br /> <br /> On motion of Mr. Smith and secnnded by Mr. Johnson, the following resolution ~as <br />adopted, and~by.,the~foltowing~vetei ~ ~ ' <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY LAND TO THE VIRGINIA <br />PORT AUTHORITY AND TO RECEIVE A RECONVEYANCE OF A SIMILAR TRACT W~TH <br />CORRECTED BOUNDARIES. <br /> <br /> WHEREAS, the City of Portsmouth and the Virginia Port Authority entered into a <br />certain agreement dated March 30, 1971, with an addendum thereto dated March $0, 1972; <br />and <br /> <br /> WHEREAS, section 10 of the said agreement required the Virginia Port Authority <br />to make property transfers in favor of the City of Portsmouth under conditions specified <br />therein; and <br /> <br />of <br /> <br />in <br /> <br />W~EREAS, the Virginia Port Authority on April 16, 1973 conveyed a certain parcel <br />land to the City of Portsmouth pursuant {o. the hereinabove mentioned agreement; and <br /> <br /> WHEREAS, plans dev9loped by the Virginia Department of Highways necessitate alteratic <br />the boundaries of the aforementioned parcel; and <br /> <br /> WHEREAS, the alteration in the boundaries can most feasibly be accomplished through <br />a conveyance of the said property hereinabove mentioned by the City of Portsmouth to <br />the Virginia Port Authority and a subsequent reconveyance of a properly described tract <br />to the City of Portsmouth by the Virginia Port Authority. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is, authorized to convey the following described <br />property to the Virginia Port Authority. <br /> <br /> That certain tract, piece or parcel of'land situate in the Pinners Point <br />section of the City of Portsmouth containing 24.055 acres by survey made <br />by Langley, McDonald and Overman, Consulting Engineers, dated January 19, <br />1975, a plat of said survey being attached hereto as Exhibit A, but <br />this property is conveyed in gross and not by acreage, being more pattiL <br />cularly bounded and described as follows, to-wit: <br /> <br /> Beginning at the point of intersection of the Northwestern right of way <br />line of the Elizabeth River Tunnel District with the Northern right of <br />way line of Seaboard Avenue Extended; thence running Northwesterly along <br /> the arc of a curve to the left, said curve having a radius of 470.74 <br />feet, a distance of 197.31 feet; thence running North 25°39'32'' East <br />46.12 feet; thence running North 5~22' East 76.2 feet; thence running <br />North 11°25'$0 TM West 126.26 feet; thence running Westerly along the arc <br />of a curve to the left, said curve having a radius of 470.0 feet, a <br /> ; <br />distance of 40.38 feeti thence running South 82~35' West 53.57 feet <br />thence running North 6 40 50 East 1075.1] feet to the Pierhead Line <br />for the Western Branch of the Elizabeth River; thence following the <br />Pierhead Line North 88°34'50'' East 580.0 feet to a point of intersection <br />of the Pierhead Line of the EIizabeth River; thence running along the <br />last mentioned Pierhead Line South 50o19'54" East 700.85 feet to a point <br />of intersection with the Northwestern right of way line of Elizabeth <br />River Tunnel District; thence running South 45 25 10 West 1151.39 feet <br />~o a point; thence running North 44 34 50 West 3.O feet to a point; <br />thence running South 45°25'10'' West 230.79 ~eet to the said point <br />of beginning. The aforedescribed property ~s subject to a right of way <br />crossing said property owned by Virginia Port Authority for two certain <br />industrial railroad spur lines the northern most railroad spur line <br />having a right of way 30 feet on either side of the centerline of said <br />track, and the southern most railroad spur line having a right of way <br />which is 17.5 feet on either side of the centerline of said track. <br /> <br /> BE <br />receive <br />of land; <br /> <br />IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to <br />from the Virginia Port Authority a reconveyance of a properly described parcel <br />and <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to <br />complete all transactions and execute all documents incident to such conveyances." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 73-409 "I submit the attached resolution and recommend its adoption. This appoints <br />five viewers for the closing of Madison Street between Fourth and Third Streets. <br /> <br /> The First National Bank of Norfolk and Willis D.
