1'27 <br /> <br />September 25, 1973 <br /> <br />I ! <br /> <br /> On motion of Mr. Smith and seconded by Mr. JohnsOn, the following resolution was <br />adopted, and by the fo!lowzng vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OF MADISON STREET <br />LOCATED BETWEEN FOURTH STREET AND THIRD STREET (S-75-15). <br /> <br /> WHEREAS, the First National Bank of Norfolk and Willis D. Jenkins have <br />made application to vacate and close the hereinafter described portion of a certain - <br />street and it appearing that notice of the application and request for the appointment <br />of viewers was duly posted on September 6, 1975 on the several bulletin boards of <br />the Circuit Court of the City of Portsmouth and on the bulletin board of the General <br />District Court of the City of Portsmouth. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that Frank N. Bilisoly, Raymond Tweed, James V, McGehee, R. Irvine Smith, and James <br />L. Choate, be appointed viewers to view the hereinafter described portion of such <br />street and report to this Council in writing whether in their opinion, any, and if <br />any, what inconvenience would result from vacating and closing the following: <br /> <br /> Beginning at an iron pin at the southeast intersection of Fourth <br />and Madison Streets; thence in an easterly direction along the <br />southern right of way of Madison Street 90 feet to an iron pin; <br />thence along said right of way 270.00 feet more or less to the south~ <br />west intersection of Madison Street and Third Street (now property <br />of United States Government); thence in a northerly directiofi along <br />the western right of way of Third Street (now property of United <br />States Government) 60.00 feet more or less to the northern right of <br />way of Madison Street; thence in a westerly direction along.the <br />northern right of way of Madison Street 560.00 feet more or less to <br />the northeastern intersection of Madison Street and Fourth Street; <br />thence in a southerly direction along the eastern right of way of <br />Fourth Street 60.00 feet more or less to the point of beginning." <br /> <br />Ayes: Early, Johnson, King, Smith, Wentz, Barnes <br />Nays: Holley <br /> <br /> 73-410 - "The Commonwealth's Attorney has applied to the State Compensation Board <br />to employ an additional Attorney for his office. The Compensation B0ard has approved <br />the employment of this Assistant Attorney at a salary of $10,500, of which the City <br />is required to pay one-half. They have also approved an allowance of $580, of which <br />the City is required to pay two-thirds. The Board's approval is subject to City Council <br />concurrence. <br /> <br /> For the information of the City Council; there is attached copies of letters <br />of the Commonwealth's Attorney justifying the employment of this additional Attorney." <br /> <br /> Motion of.Mr. King and seconded by Mr. Smith, the matter be referred to the Finance <br />Commission. <br /> <br />Substitute motion of Mr. Holley and seconded by Mr. Johnson, the request be granted. <br /> <br /> Substitute motion of Mr. Johnson and seconded by Mr. Holley, to be ref&rred~;to the <br />City Manager and Finance Commission, was adopted by the following vote: <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 73-411 "I submit herewith the attached ordinance and recommend it be placed <br />on first reading. This amends the ordinance recently adopted granting tax relief <br />for the elderly. These are all administrative amendments necessary in order that the <br />ordinance can be properly administered. This does not change any of the requirements <br />or benefits in the original ordinance." <br /> <br /> On motion of Mr. Smith and seconded by Mr. Early, the following ordinance was approv <br />ed on first reading, and ~y the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH~ VIRGINIA, 1961, <br />BY AMENDING SECTIONS 10-6S.1, 10-6S.4, 10-6S.S, 10'65.? AND 10-65.8 PERTAIN- <br />ING TO REAL ESTATE TAX RELIEF FOR CERTAIN ELDERLY PERSONS." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 75-412 "I am in receipt of letters from the Sgt. William H. Harrison, Post 190 <br />of the American Legion, and the Westhaven Garden Club requesting bingo permits. These <br />have been approved by the City Attorney's office. I, therefore, recommend a permit be <br />granted." <br /> <br /> Motion of Mr. Smith and. secondedi~by Mr. Johnson, that the permits be granted, was <br />adopted by unanimous vote. <br /> <br /> <br />
