<br />following as my report on the Commonwealth
<br />
<br /> The reorganization of the Courts on July i of this year, and the appointment of
<br />an additional Judge by the State, has created a request for an additional attorney for
<br />the Commonwealth which was not known when the budget was adopted in July of this year.
<br />During my discussion with Mr. Cales, the Commonwealth's Attorney, I was advised that
<br />a minimum of 5 attorneys are required daily for the Courts and that 6 attorneys were
<br />required at least 3 times a week when all 6 Judges were trying cases at the same time.
<br />Also, the Commonwealth Attorney's Office is required by State law to prosecute State
<br />misdemeanors at the request of the Judge, and is required by City Charter to prosecute
<br />all City misdemeanors at the request of the Judges. Mr. Coles advises that the Judges
<br />have requested that he have an attorney present in each of the Courts when they are trying
<br />cases.
<br />
<br /> The City's share of the additional attorney for the remainder of this fiscal year
<br />will be approximately $4,000. I have been advised by the Finance Director that due to
<br />the take-over of the Probation Officers by the State on September 1 of this year that
<br />sufficient funds are available in the judicial category of the current budget to meet
<br />the City's share.
<br />
<br /> Based on the above, I recommend that you concur with the State Compensation Board
<br />in approving one additional position of Assistant Commonwealth's Attorney at an annual
<br />salary of $10,500."

<br /> Motion of Mr. Johnson and seconded by Mr. Holley, to concur in the recommendation of
<br />the City Manager, was adopted by the following vote:
