138 . <br /> <br /> WHEREAS, the City of Portsmouth has no further need for said parcel, and it <br />therefore, surplus property, and has been so declared by the Planning Commission. <br /> <br />is, <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is, authorized to advertise and receive bids <br />for the hereinabove described property on such terms and subject to such minimum bid <br />restrictions as he may deem proper." <br /> <br />the <br />ant. <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br />at the last Council meeting, I submit <br />Attorney's request for an additional assist <br /> <br /> 73-435 "In accordance with your request <br />following as my report on the Commonwealth <br /> <br /> The reorganization of the Courts on July i of this year, and the appointment of <br />an additional Judge by the State, has created a request for an additional attorney for <br />the Commonwealth which was not known when the budget was adopted in July of this year. <br />During my discussion with Mr. Cales, the Commonwealth's Attorney, I was advised that <br />a minimum of 5 attorneys are required daily for the Courts and that 6 attorneys were <br />required at least 3 times a week when all 6 Judges were trying cases at the same time. <br />Also, the Commonwealth Attorney's Office is required by State law to prosecute State <br />misdemeanors at the request of the Judge, and is required by City Charter to prosecute <br />all City misdemeanors at the request of the Judges. Mr. Coles advises that the Judges <br />have requested that he have an attorney present in each of the Courts when they are trying <br />cases. <br /> <br /> The City's share of the additional attorney for the remainder of this fiscal year <br />will be approximately $4,000. I have been advised by the Finance Director that due to <br />the take-over of the Probation Officers by the State on September 1 of this year that <br />sufficient funds are available in the judicial category of the current budget to meet <br />the City's share. <br /> <br /> Based on the above, I recommend that you concur with the State Compensation Board <br />in approving one additional position of Assistant Commonwealth's Attorney at an annual <br />salary of $10,500." <br /> <br /> Motion of Mr. Johnson and seconded by Mr. Holley, to concur in the recommendation of <br />the City Manager, was adopted by the following vote: <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, W~ntz, Barnes <br />Nays: None <br /> <br /> 73-436 - "I submit the attached ordinance and recommend it be placed on first reading <br />This closes a portion of Madison Street between Fourth and Third Streets.
