217 <br /> <br />1974 <br /> <br /> 74-56 - "I submit the attached ordinance and recommend it be placed on first reading <br />This appropriates $29,645.57 in the Capital Improvement Fund for improvements to Sleepy <br />Hole Park 5oif Course, This appropriation is for the funds appropriated on a previous <br />ordinance from the Revenue Sharing Trust Fund for capital expenditures in the category of <br />recreation. <br /> <br /> The above appropriation includes $21,676 for bulkhead work necessary around the 18th <br />green of the golf course to protect this green from erosion, $1,494 for three drinking <br />fountains, $5,475 for.'a 6~ft. high chain link fence, and $1,000 to install drain pipes <br />under the fence along the highway." <br /> <br /> On motion of Mr. smith and seconded by Mr. Johnson, the following ordinance was <br />approved on first reading, and by the following vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $29,645.57 IN THE GENERAL CAPITAL IMPROVEMENT <br />FUND FOR CAPITAL IMPROVEMENTS AT SLEEPY HOLE PARK." <br /> <br />Ayes: <br />Nays: <br /> <br />Johnson, King, Smith, Wentz, Barnes <br />None <br /> <br /> 74-57 "City Council, at its last meeting, requested that the City Manager investiga: <br />and report back on a building which has been moved to 301 Taft Drive from another location <br />Council received a petition from the residents of the 300 block of Taft Drive concerning <br />this matter. The petition stated that this building would be a hazard to the community <br />because 7 feet was not enough distance from the gas plant. They also stated that the <br />house would bring down the value of properties zn that area. <br /> <br /> The building that was moved onto the lot at 301 Taft Drive meets the Building <br />Code and the Zoning Ordinance of the City of Portsmouth. The building is sound and <br />permits have been issued for two additions to it. Upon completion, this building will <br />equal or exceed the value of those in the immediate vicinity. The lot on which it was <br />placed is the largest lot in the area. ~'~en completed, this building should not be <br />a detriment to the neighborhood. <br /> <br /> The gas company's fence adjoins the lot at this location; however, the fence does <br />not mark the M-1 zoning district boundary. Part of the area o~med by the gas company <br />within their fenced property is residential zoning. The gas company operation ~s approxi- <br />mately 100 feet east of this fence. The house in question is 12 feet from the east <br />pr~per.Vy line and this is a much greater distance than the law requires. The Zoning <br />Ordinance requires at least 20 feet adjacent to the residential district when an industria <br />district abuts such a residential district. In the event of expansion by the gas company <br />this requirement would have to be maintained on their side of the fence." <br /> <br /> Motion of Mr. Smith and seconded by Mr. King, to be received as information and a <br />copy be sent to the petitioner, was adopted by unanimous vote. <br /> <br /> 74-58 -"~submit the attached resolution and recommend it be adopted. This isiin <br />support for passage of House Bill No. 1 dealing with the State-wide Building Code. <br />Delegate Schlitz ~s a patron of this bill. <br /> <br /> This would allow any county, city or town which adoptes a local Building Code con- <br />forming to the standards of the Southern Building Code Congress to be exempt from the <br />State-wide Building Code. This will allow us to continue using the codes that we are <br />now using. A similar resolution was passed last year." <br /> <br /> On motion of Mr. Smith and seconded by Mr. King, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION REQUESTING THE REPRESENTATIVES OF THE CITY OF PORTSMOUTH IN <br />THE GENE~&L ASSEMBLY TO VIGOROUSLY SUPPORT DURING THE 1974 SESSION OF THE <br />ASSEMBLY, HOUSE BILL 1 RELATING TO THE USE OF THE SOUTHERN STANDARD BUILD- <br />ING CODE AS AN ALTERNATIVE TO THE BUILDING CODE PRESENTLY PRESCRIBED BY TB~ <br />UNIFORM STATE WIDE BUILDING CODE. <br /> <br /> WHEREAS, the State Board of Housing pursuant to legislation of the General Assembly <br />has adopted as the Uniform State Wide Building Code a building code different from the <br />one presently in use in Portsmouth; and <br /> <br /> ~{EREAS, the Southern Standard Building Code is the code presently in effect in <br />the City of Portsmouth; and <br /> <br /> WHEREAS, it is the preference of the Council of the City of Portsmouth that the <br /> Southern Standard Building Code be allowed to be continued in use indefinitely in the <br /> City of Portsmouth; and <br /> <br /> WHEREAS, House Bill 1 as proposed would allow localities to utilize the Southern <br /> Standard Building Code as an alternative to the code presently prescribed in the Uniform <br /> State Wide Building Code. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the representatives of the City of Portsmouth in the General Assembly be, and are <br />.hereby requested to support ~use Bill 1 during the 1974 Session so as to allow localities <br />the continued use of the Southern Standard Building Code." <br /> <br /> <br />
