<br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY
<br />OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOBBIN PROCEEDINGS PURSUANT TO C~PTER
<br />471 OF THE ACTS OF ASSEMBLY OF 1970, AS AMENDED, SAID PROPERTY BEING NEC-
<br />ESSARY FOR THE WIDENING OF VICTORY BOULEVARD NEAR ITS INTERSECTION WITH AIR-
<br />LINE BOULEVARD.
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest here-
<br />inafter specified in and to the hereinafter described parcel of land situate in the City
<br />of Portsmouth, Virginia, for the purpose of widening Victory Boulevard; and
<br />
<br /> ~VHBREAS, the City of Portsmouth has not been able to purchase the property described
<br />herein, necessary to the project, because the owners thereof and the City have not been
<br />able to agree upon the price to be paid therefor, or the City has not been able to locate
<br />certain of the owners or because of the status of the title of the property; and
<br />
<br /> k~iEREAS, advancement of the work and use of said project will be delayed unreasonably
<br />if the said property is not made available as soon as possible.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> 1. The City Attorney is directed to institute eminent domain proceedings, employing
<br />special counsel for that purpose if he deems it advisable, against the following property
<br />situate in the City of Portsmouth, for the purpose of acquiring fee simple title therein,
<br />together with any and all easements of access, light or air incident to the lands of
<br />the landowner abutting upon said property, in accordance with and pursuant to Sections
<br />2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts
<br />of Assembly of 1970, as amended), and to deposit to the credit of t~ court as provided
<br />by law the sum hereafter specified to compensate the owners of the parcel of land, as
<br />shown on that certain plat entitled, "Plat Showing Proposed Right of Way Acquisition
<br />For Improvements To Intersection Of Airline Boulevard and Victory Boulevard From Unknown
<br />Owner", dated May 22, 1973, a copy of which is filed with the Department of Engineering
<br />of the City of Portsmouth, Virginia.

<br /> 74-77 "I submit the attached resolution and recommend its adoption. This resolutio:
<br />authorizes the City Manager to accept the bid of the Biltmore Baptist ChurCh to purchase
<br />City-owned property on the north side of Elliott Avenue adjacent to the church.
<br />
<br /> The City Planning Commission received a request from Biltmore Baptist Church asking
<br />that this 100-ft. wide'strip of property be considered as surplus and sold since the
<br />church desired to use it for purposes of expansion. The Planning Commission recommended
<br />approval of this request and the property was advertised for sale. The advertisement
<br />stated a minimum acceptable bid of $8,000.
<br />
<br /> The only bid received was from Biltmore Baptist Church in the amount of and for
<br />the minimum acceptable bid of $8,000."

<br /> On motion of Mr. King and seconded by Mr. Smith, the following resotutiQn was
<br />adopted, and by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING TIKE CITY MANAGER TO ACCEPT THE BID OF THE BILTMORE
<br />BAPTIST CHURCH TO PURCHASE CERTAIN CITY-OWNED PROPERTY (NORTH SIDE OF ELLIOTT
<br />AVENUE).
<br />
<br /> WHEREAS, the Council of the City of
<br />certain property, hereinafter described,
<br />for City purposes; and
<br />
<br />Portsmouth, Virginia, has determined that
<br />is surplus property and no longer required
<br />
<br /> WHEREAS, the Council has authorized the City Manager to advertise this property
<br />for sale upon certain terms and conditions; and
<br />
<br /> wHEREAs, the City Manager has caused the said property to be advertised in accordance
<br />with the said authorization; and
<br />
<br /> I~EREAS, the Biltmore BaptiSt Church has submitted a bid in response to said adver~
<br />tisement, such bid being the minimum bid stated and being the only bid received; and
<br />
<br /> WHEREAS, the Council finds, after due consideration, that the bid of the Biltmore
<br />Baptist Church complies fully with the terms of the City's advertisement and will permit
<br />the disposition of the property on terms most favorable to the City.
<br />
<br /> NOW, THEREFORE[~BE IT RESOLVED by :Ebb'COUncil of the City of Portsmouth, Vir~ih{a,
<br />that the City Manager be, and he hereby is directed to accept the bid of the Biltmore
<br />Baptist Church for the hereinafter described property.
