At a regular City Council meeting held on February 26, 1974, there were present:

<br /> Motion of Mr. Smith and seconded by Mr. Johnson, minutes of the Public Hearing
<br />meeting of February 11, 1974, regular meeting of February 12, 1974, and Special meeting
<br />of February 22, 1974, to be approved as received was adopted by the following vote:

<br />The following reports from the City Manager were read:

<br /> 74-75 ~ "I submit the attached resolution and recommend its adoption. As part
<br />of its program to preserve the existing public transportation system and then expand
<br />services to areas not presently served, the Tidewater Transportation Commission has
<br />explored possible funding sources to finance the acquisition of the bus company, restore
<br />them to an adequate operational level and buy new buses and other facilities for services
<br />
<br /> Highway Aid-to-Mass-Transit Funds can be made available to the Tidewater Transportati
<br />Commission if each of the four cities in the Commission passes this resolution requesting
<br />that the State Highway Commission allocate certain funds. These are primary and urban
<br />funds which can be used in the purchase of buses and facilities for public transit systems
<br />
<br /> The resolution states that utilization of these
<br />posVponement, deferral, or elimination of any single
<br />programmed within the transportation district."

<br /> On motion of Mr. Johnson and seconded by Mr. Smith, the following resolution was
<br />adopted, and by the following vote:

<br />"A RESOLUTION REQUESTING THE STATE HIGHWAY COMMISSION TO USE FUNDS ALLOCATED
<br />TO THE CITIES COMPRISING THE TIDEWATER T~iNSPORTATION DISTRICT FOR THE PURCHASE
<br />OF BUSES AND ANCILLARY FACILITIES FOR PUBLIC TRANSPORTATION SYSTEMS.
<br />
<br /> W~EREAS, the State Highway Commission may allocate funds in urban corridors for
<br />aid to mass transit facilities in accordance with the provisions of Section 33.1-46.1
<br />of the Code of Virginia (1950); and
<br />
<br /> WHEREAS, the State Highway Department has estimated the need for Aid to Mass Transit
<br />for the Ten-Year Highway Fiscal Program, 1972-73 through 1981-82, for the Suffolk Dis-
<br />trict to be $40,OOO,OOO, thus committing the State Highway Commission to allocate this
<br />amount of primary and urban funds to specific transit projects during this period; and
<br />
<br /> WHEREAS, the 1973 session of the General Assembly enacted an amendment to the Code
<br />of Virginia that allowed the State Highway Commission, at the request of local governing
<br />bodies, to use funds allocated for urban highways to aid the transportation district
<br />of which they are units in the purchase of buses and ancillary facilities for public
<br />transit Systems; and
<br />
<br /> WHEREAS, the Tidewater Transportation Commission has an immediate and critical
<br />need for funds to purchase buses and ancillary facilities so as to preserve, restore,
<br />and expand public transportation within the Tidewater Transportation District, which
<br />is composed of the Cities of Chesapeake, Norfolk, Portsmouth, and Virginia Beach; and
<br />
<br /> WHEREAS, the utilization of funds for aid to mass transit will no~ cause the delay,
<br />postponement, deferral, or eliminatioa of any single highway improvement project currently
<br />programmed within the Tidewater Transportation District.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that in accordance with the provisions of Section 33.1-46.1 of the Code of Virginia (1950)
<br />the State Highway Commission is requested to use approximately Six Million ($6,000,000.)
<br />Dollars of urban highway funds allocated or ~o be allocated within the Cities of Chesapeak
<br />Norfolk, Portsmouth and Virginia Beach to aid the Tidewater Transportation Commission
<br />· n the purchase of buses and ancillary facilities for public transit systems to be operate~
<br />within the Tidewater Transportation District."

<br />provides for the acquisition of property by the City under eminent domain proceedings
<br />pursuant to Chapter 471 of the Acts of the Assembly of 1970 (as amended). This property
<br />ms necessary for the widening of Victory Boulevard near its intersection with Airline
<br />Boulevard and is 0.110 acres in size. The o~er of this property is unknown.
<br />
<br />This property has been appraised and the market value established at $2,650."
