<br /> 74-141 - "The attached resolution is submitted for your consideration and I recom-
<br />mend its adoption. This authorizes a joint meeting with the Planning Commission and
<br />the City Council to consider a request by Maryview Hospital for a use permit. A public
<br />hearing will be held on this matter at this meeting.
<br />
<br /> Through oversight of the zoning requirements for anticipated construction, Maryview
<br />Hospital has never applied for nor obtained a use permit for the operation of the
<br />hospital on its present site. Since the hospital is prepared to begin new construction,
<br />the Building Official has advised them that they must meet the requirement of our
<br />present Zoning Ordinance which states that they must obtain a use permit for its operatioi
<br />In order for Maryview to meet the time requirement of a commitment to HEW, it is necessar'
<br />that the City act quickly upon the hospital's application for a use permit. Attorneys
<br />for the hospital have requested that~a special meeting of the Planning Commission
<br />and City Council be held at 7:00 p.m. on Tuesday, April 25, 1974."

<br /> On motion of Mr. Smith and seconded by Mr. Johnson, the following resolution was
<br />adopted, and by the following vote:
<br />
<br />"A RESOLUTION TO PROVIDE FOR A SPECIAL JOINT MEETING OF THE PLANNING COM~4tSSION
<br />AND CITY COUNCIL TO CONSIDER A REQUEST FOR A USE PERMIT BY MARYVIEW HOSPITAL.
<br />
<br /> WHEREAS, Maryview Hospital is presently located in a district zoned residential;
<br />and
<br />
<br /> WHEREAS, Maryview Hospital was built prior to the establishment of such residential
<br />district and is, therefore, denominated as a non-conforming use under the present
<br />Zoning Ordinance; and
<br />
<br /> WHEREAS, under said Zoning Ordinance, non-conforming uses are generally prohibited
<br />from expansion; and
<br />
<br /> WHEREAS, Maryview Hospital desires to expand its facilities and the Zoning Ordinanc~
<br />provides that such a hospital may become a conforming use if it is granted a use per-
<br />mit for such residential zoning district; and
<br />
<br /> WHEREAS, Maryview Hospital must obtain such use permit in order to expand its
<br />facilities, and
<br />
<br /> WHEREAS, Maryview Hospital has requested that because of the exigencies of its
<br />proposed construction schedule, its petition for a use permit be considered at a joint
<br />meeting of the Planning Commission and City Council; and
<br />
<br /> WHEREAS, in accordance with Section 2-42 of the Code of Portsmouth, 1975, such
<br />a deviation from its normal scheduled meetings requires a special resolution grant_lng
<br />same.

<br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Portsmouth, Virginia,
<br />does hereby provide that a special joint meeting of the Planning Commission and City
<br />Council be held at 7:00 P.M., April 23, 1974, prior to its regularly scheduled meeting,
<br />in the City Council Chambers, Fourth Floor, Municipal Building, High Street, for the
<br />purpose of entertaining a petition by Maryview Hospital for the granting of a use permit.

<br /> 74-142 - "The attached ordinance is submitted for your consideration and I recommend
<br />that it be placed on first reading. This appropriates $1,555,168 from the Revenue
<br />Sharing Trust Fund. This ordinance appropriates all of the operating, maintenance
<br />and equipment expenditures previously approved for use in the 1975-74 Operating Budget.
<br />
<br /> The total appropriation of $1,555,168 will be for the following categories and
<br />in accordance with the Revenue Sharing guidelines:
<br />
<br />(1) Public Safety
<br />(2) Environmental Protection
<br />($) Public Transportation
<br />(4) Health
<br />(5) Recreation
<br />(6) Libraries
<br />(7) Financial Administration
<br />(8) Equipment fQr General and
<br /> Multi-purpose Use' .

<br /> The above totals by categories were adopted previously as part of the Planned
<br />Use Report for Entitlement IV Funds to be received by the City during fiscal 1975-
<br />74. The balance of Entitlement IV which has been commlitted for capital expenditures
<br />in the area of curbs, gutters, drainage, streets and highways will be appropriated
<br />upon completion of engineering and receipt of bids for each project."
