329 <br /> <br /> for the problem and have pledged to do everything possible to eliminate it. <br /> <br /> In a letter dated July 2, 1974, Mr~ Tackney requested that the City provide them <br /> with notices used by the City to advise citizens of violations of trash and garbage <br /> ordinances. These have been forwarded to him. It is Mr. Tackney's intention to serve <br /> notice from his office and from ours to carriers found violating these rules. He promise~ <br /> that newspaper officials will make a conscientious effort to police their carriers so <br /> as to stop the occurrence of their littering City str.eets and private property. <br /> <br /> I am attaching to this report a copy of a letter from the Pilot Circulation Manager <br /> to the Cradock Property Owners Association," <br /> <br /> Motion of Mr. Wentz and seconded by Mr. Barnes, to be received as information, was <br /> adopted by unanimous vote. <br /> <br /> 74-291 - "After receiving a letter from Mrs. Rosalyn B. Ellis, City Council instruct- <br /> ed me to investigate her complaint concerning dust from an unpaved section of Harvey <br /> Street. After receiving a recommendation from the Director of Public Works, paving <br /> of this street was authorized and is scheduled to be completed within the next two weeks. <br /> <br /> This section of Harvey Street is not a connector street and should have limited <br /> usage. The Traffic Engineering Department has been requested to restrict truck traffic <br />'on this street after surface treatment has been completed." <br /> <br /> Motion of Mr. Wentz and seconded by Mr. Barnes, to be received as information, was <br /> adopted by unanimous vote. <br /> <br /> 74-292 - "Resolution approving grant application by the Mental Health and Mental <br />Retardation Board. <br /> <br /> This is in accordance with Section 16-44 of the City Code and Section 198, Chapter <br />10, Title 37.1 of the Code of the Virginia which requires approval by City Council before <br />State and Federal funds will be made available to~:the Board." <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Barnes, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION ENDORSING AND APPROVING A GRANT APPLICATION TO BE SUBMITTED <br />BY THE PORTSMOUTH MENTAL HEALTH AND MENTAL RETARDATION SERVICES BOARD. <br /> <br /> WHEREAS, the City of Portsmouth Mental Health and Mental Retardation Services Board <br />has.prepared a certain grant application entitled "Comprehensive Community Mental Health, <br />Me,tat Retardation, Substance Abuse Program" to be submitted to appropriate state and <br />federal ~agencies for approval and funding; and <br /> <br /> WHEREAS, it is necessary that this Council approve and endorse the aforesaid program <br />and certify such approval and endorsement to appropriate state and federal agencies; <br />and <br /> <br /> WHEREAS, this'Council has reviewed the aforementioned program and found such program <br />to be logically conceived, properly planned and well adapted to the solution of the <br />various problems addressed by the program. <br /> <br /> NOW, THEREFORE, BElT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that it does hereby approve and endorse the "Comprehensive Community Mental Health, <br />Mental Retardation, Substance Abuse Program" which was previously adopted by the Mental <br />Health and Mental Retardation Services Board on April 10, 1974. <br /> <br /> BE IT FURTHER RESOLVED that the City Clerk is authorized and directed to prepare <br />a certified copy of this resolution to be submitted to appropriate state and federal <br />agencies in support of the grant application for this program." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 74-293 - "At its meeting on June 12, 1974, the Tidewater Transpor%ation Commission <br />considered the establishment of a fringe parking lot at the interchange of Route It264 <br />and Greenwood Drive in the City of Portsmouth. This project had been discussed previously <br />by the Director of Planning and officials of the Virginia Department of Highways, and <br />approved by the Planning Commission (letter from the Chairman attached). The Highway <br />Department has received approval from the Federal Government for use of Federal interstate <br />funds to develop this lot. Total cost of construction would utilize Federal and State <br />funds on a 90-10 ratio basis. The Tidewater Transportation Commission has agreed to <br />maintain the lot in accordance with provisions of the transit service and cost allocation <br />agreement to be approved by each of the four participating cities. <br /> <br /> The property on which the proposed parking lot would be constructed is owned by <br />the City of Portsmouth. The Transportation Commission is requesting that the City give <br />an easement for use of this property to the Commission. I am of the opinion that the <br />City should receive compensation for the use of this property, and have discussed this <br />with James C. Echols, Executive Director for the Commission. He has agreed to recommend <br />such an arrangement to the Transportation Commission. This easement should have a reversi <br />clause whereby the property would revert back to the City at any time that it is no <br /> <br /> <br />
