his letter to Council (i.e., no inflammable or combustible materials will be stored, <br />placed or caused to be stored or placed thereon). There was a second fire on the premise~ <br />on June 20, 1969.- <br /> On January 22, 1968, the Zoning Officer of the City officially informed the City <br />Manager that inflammable and combustible materials were stored and placed on the subject <br />premises. <br /> On the basis of the foregoing, the City Council unanimously voted to revoke petition~ <br />Use Permit on March 12, 1968. <br /> The City Council on October 24, 1972, adopted the "Zoning Ordinance of the City <br />of Portsmouth, 1972.' <br /> <br /> The Zoning Officer stated that the property in question was currently zoned M- <br />i (see Section 4-3 of the "Zoning Ordinance of the City of Portsmouth, 1972"), and that <br />Section 4-3 does not allow the operation of a junkyard. <br /> Mr. Jacobsen was subsequently convicted of fifty-five (55) violations of the "Zoning <br />Ordinance of the City of Portsmouth, 1972". By agreement of counsel, one of the fifty- <br />five cases was set for trial in the Circuit Court of the City of Portsmouth. It is <br />from this conviction that the petitioner has appealed to the Supreme Court of the Commonw <br />wealth of Virginia. May you be advised that effective immediately, I have instructed <br />all members of the Special Investigative Diiision of this Department to maintain a heavy <br />~B~ro] and surveillance of the area. If you can supply specific information as to in- <br />dividuals and specific acts of lawlessness that may be witnessed by you,I would appreciat~ <br />you forwarding this information to this division either by mail or by telephone. Thank <br />you for your cooperation in this matter. Signed Sst. B. D. Wood, Special Investigative <br />Division" <br /> <br />Public Health Department <br /> <br /> "The Westgrove Apartments are located at 201 Dixie Avenue and 200 Pullman Avenue and <br />consist of 16 apartments. <br /> <br /> Since the Rental Program was initiated we have inspected 10 apartments and 6 of these <br />have been made within the past 6 months. Only one violation was found out of the 10 <br />apartments inspected, and this was a m~nor vi61ation. The grounds are in good condition an <br />dumpster is provided for trash and garbage disposal. Walker, 1749 Spratley <br />Street, was read: <br /> <br />"SUBJECT: The Agenda of the 13 August, 1974 Portsmouth City Council Meeting <br /> <br /> Pursuant to Council Gag Rules 2-15.1 and 2.24 (1961 Code Sections) it is requested <br />that my name be placed on the agenda of the subject meeting to continue the inquiry into <br />the status of the Department of Public Safety under n~w City Code Sections 2-164 and 2-16 <br />carried over from the 23 July, 1974 meeting due to passage of ten (10) minutes~eaking <br />time allowed under abovesaid rules." <br /> <br /> Motion of Mr. Holley and seconded by Mr. Wentz, to be received as information and the <br />City Attorney review Provisions of the City Code relating to Department of Public Safety <br />a~d report back as to whether city is in compliance with those prsvisions, was adopted by <br /> <br />unanimous vote. <br /> <br /> 74-351 - The following <br />Board, was presented: <br /> <br />letter received <br /> <br />from Mr, Bradford L. Cherry, President, YMCA <br /> <br /> 'The Portsmouth YMCA underwent a sever~ fire on May 2. We were in the process of <br />discussing plans for a new YMCA; and the fire, coupled with parking problems, expensive <br />upkeep has made the construction of a new building our most important interest. <br /> We have examined land for our new location and the board agrees that the YMCA should <br />be loca/~d in a central point to serve the citizens of our city.
