Blac,hman, Herbert L. Willard and James <br />Choate, be appointed viewers to view the hereinafter described portion of such street and <br />report to this Council in writing whether in their oPinion, any, and if any, what inconven <br />ience would result from vacating and closing the following: <br /> <br /> All that certain lot or parcel of land <br />:Virginia, and described as follows: <br /> <br />situate <br /> <br />in the City of PortsmOuth, <br /> <br /> Beginning at a point in the northern line of County Street at the South- <br />west corner of Lot No. 24 in Block 141 as shown on the plat of Livingston Land <br />Company of record in the Office of the Clerk of the Circuit Court of the City <br />of Chesapeake, Virginia, in Map Book 5, at Page 45; thence in a northerly <br />direction along the western line of said Lot 24 and continuing along the <br />western line of Lot 25 in said Block 141 a distance of 150 feet, more or less, <br />to the easte~tyy line of the right of way of Seaboard Coastline Railroad; <br />thence in a southwesterly direction along the line of said right of way a <br />distance of 75 feet, more or less, to the eastern line of Lot No. 2, in <br />Block 140 on the above plat; thence in a southerly direction along the line <br />of said Lot 2 a distance of 80 feet, more or less, to the northern line of <br />County Street; thence in an easterly direction along the line of County <br />Street 60 feet to the point of beginning. This bringscthe City Code into conformance <br />with the State Code. The amendments to the other sections in this ordinance ara con- <br />cerned with identifying the board as the "Mental Health and Mental Retardation Services <br />Board". The board was formerly known as Mental Health Services Board." <br /> <br /> On motion of Mr. Early and seconded by Mr. Wentz, the following ordinance was ap- <br />proved on first reading, and by the following vote: <br /> <br />"AN ORDINANCE TO ~dEND TF~ CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY ~4ENDING SECTIONS 16-39, 16-40, 16-41, 16-42, 16-43, AND 16-44 PERTAIN- <br />ING TO THE COi~qUNITY MENTAL HEALTH AND MENTAL RETARDATION SERVICES BOARD." <br /> <br />Aves: Barnes, Early, <br />Nays: None <br />Abstainin~ Holley <br /> <br />Elliott, Oast, Wentz, Davis <br /> <br /> 74-542 "Ordinance on first reading to amend Section 8-27 of the City Code pertain- <br />ing to charges for bail bonds. <br /> <br /> This ordinance would amend the City Code to permit bail bond fees up to 15% of the <br />amount of the bond. The fee is currently limited to 10%. This amendment has~been re- <br />quested by the local bail bondsmen." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Wentz, the following ordinance was ap- <br />proved on first reading, and by the following vote: <br /> <br />"AN ORDINANCE TO ~4END T[~ COUE'OF ~ CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY AMENDING SECTION 8-27 THEREOF PERTAINING TO SURETY~ FEES FOR BAIL BONDS." <br /> <br />Ayes: Barnes, Early, <br />Nays: Non~ ~ <br />Abstaining: Holley, Oast <br /> <br />Elliott, <br /> <br />Wentz, Davis <br /> <br /> 74-543 "Consideration of a resolution requesting the-State Highway Commission to <br />participate in the construction of an Industrial Access Road. <br /> <br /> This resolution certifies the intent of the City of Portsmouth to construct an <br />industrial access road (Elmhurst Lane Extended) and requests the State Highway Commission <br />to part'icipate in the funding of this project." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Wentz, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION REQUESTING THE STATE HIGHWAY COMMISSION TO PARTICIPATE IN <br />THE CONSTRUCTION OF AN INDUSTRIAL ACCESS ROAD IN THE CITY OF PORTSMOUTH. <br /> <br /> WHEREAS, Section 35.1-221 of the Code of Virginia, 1950, authorizes the State High- <br />way Commission to participate in the cost of construction of industrial access roads; a~d <br /> <br /> <br />
