September 10, 1974 <br /> <br /> The Planning Commission has approved this application for closure smbmitted by Mrs. <br />J. R. Austin, Mrs. C. C. Williams and Mr. Frank B. Baker, Jr. The appointed viewers have <br />examined the street and submitted a report recommending closure, cop)- attached. The City <br />Manager recommends-adoption of the ordinance." <br /> <br /> On motion of Mr. Early and seconded by Mr. Holley, the fo~Iowing ordinance ~as ap- <br />proved on first reading by unanimous vote: <br /> <br />"AN ORDINANCE CLOSING A PORTION OF AN ALLEY LOCATED WEST OF THE INTERSECTION <br />OF LECKIE STREET AND PENINSULA AVENUE." <br /> <br /> 74-385 "Consideration of ordinance on first reading to amend Section 2-165 of the <br />City Code pertaining to the Department of Public Safety. <br /> <br /> This section, as amended, clarifies and makes explicit the responsibilities and <br />duties of the City Manager when he acts as Director of Public Safety. This section furth <br />permits the City Mana~e~_to perform the executive and ministerial functions of the Depart <br />menr of Public Safety by utilizing City resources presently at his disposal. Under the <br />amendment, the City is still required to have a Department of Public Safety but it is not <br />required to commit perso, n~e2~nd other r~onrces exclusively to that department." <br /> <br /> Motioniof Mr. Wentz and seconded by Mr. Elliott the following ordinance~to be de- <br />ferred to the next meeting (September 17, 1974). <br /> <br /> The following request to speak received from George R. Walker, 1749 Spratley Street, <br />was read: <br /> <br />"Subject: The Agenda of the 10 September, 1974 Portsmouth City Council Meeting. <br /> <br /> Pusuant to Council Gag Rules 2-15.1 and 2-24 (1961 Code) it is requested that my <br />name be placed on the agenda of the subject meeting to addr'ess the proposed Department <br />of Public Safety Ordinance, Item 74-385 prior to Council action thereon." <br /> <br />Mr. Walker spoke. <br /> <br />The motion to defer:the ordinance was adopted by unanimous vote. <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY AMENDING SECTION 2-165 THEREOF PERTAINING TO THE DEPARTMENT OF PUBLIC <br />SAFETY." <br /> <br /> 74-386 <br />expend $1,670 <br />Terminal. <br /> <br />"Consider.ation .of.a.resolution authorizing the Virginia Port Authority to <br />for the construction and erection of an entrance sign at P6~smouth Marine <br /> <br /> This expenditure was requested by resolution of the Board of Commissioners of the <br />Virginia Port Authority at its regular meeting ora~the 15th bf May, 1974. This resolution <br />is required by the Portsmouth Unification Agreement and the Port Authority's Coun~ll is <br />requesting approval of the expenditure from the port revenues." <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Elliott, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION TO AUTHORIZE THE VIRGINIA PORT AUTIIORITY TO EXPEND FUNDS FROM <br />SURPLUS REVENUE FOR CAPITAL IMPROVEMENTS AT THE PORTSMOUTH MARINE TERMINAL. <br /> <br /> WF~REAS, the ~Virginia Port Authority has requested authorization from Portsmouth <br />City Council to expend funds for certain capital improvements to the Portsmouth <br />Marine Terminal; and <br /> <br /> WHEREAS, the Virginia Port Authority is required by the Port Unification Agreement <br />to obtain consent from City Council before making such expenditures; and <br /> <br /> YFHEREAS, the expenditures to be made will be funded from surplus revenue generated <br />by the Portsmouth Marine Terminal; and <br /> <br /> WHEREAS, Portsmouth City Codncil after duly considering the contemplated improvement <br />is of the opinion that such improvements are necessary and prudent investments. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that it approves the expenditure of One Thousand, Six Hundred Seventy and 00/100 <br />($1,670.) Dollars for the construction of an entrance sign at the Portsmouth Marine <br />Terminal, as contemplated by Virginia Port Authority Resolution 74-13 of May 15, <br />1974." <br /> <br />Ayes: Barnes, Early, Elliott, Oast, Wentz, Davis <br />Nays: Holley <br /> <br /> 74-387 "On August 13, 1974, a preliminary report was made to the Council <br />concerning ordinances which cover the operation of taxicabs within the City. At that <br />time, I advised the Council that I would report again on this matter following completion <br />of a staff study and meeting with cab owners. If the Council concurs in the recommendati( <br />contained in this report, ordinance changes can be prepared by the City Attorney's <br />office and placed on the agenda for the next Council meeting. <br /> <br />~s <br /> <br /> <br />
