<br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973,
<br />BY AMENDING THE TITLE OF ARTICLE VIII OF CHAPTER 2 THEREOF; BY REPEALING
<br />SECTIONS 2-162, 1-163, 2-164, 2-165, 2-166, 2-167, 2-168, 2-169 AND 2-170
<br />THEREOF; BY REPEALING AND ABOLISHING THE DESIGNATION OF DIVISIONS WITHIN
<br />ARTICLE VIII; AND BY ADDING THERETO A NEW SECTION NUMBERED 2-176 PERTAINING
<br />TO ABOLISHMENT OF THE DEPARTMENT OF PUBLIC SAFETY AND CERTAIN FINANCIAL
<br />REPORTING'PROCEDURES TO BE USED BY CERTAIN BUREAUS, DIVISIONS AND OFFICES
<br />OF THE CITY.' ....

<br /> The following letter received from George R. Walker, 1749 Spratley Street, was
<br />read:
<br />

<br />
<br /> Subject: The Agenda of the 8 October, 1974 Portsmouth City Council Meeting.
<br />
<br />Pursuant to Council Gag Rules 2-15.1 and 2-24 (1961 Code Sections) it is requested
<br />my name be placed on the subject agenda to address Item 74z385.
<br />
<br /> For purposes of identification it is noted that this matter is the same as that
<br />placed before Council on 10 September, 1974 amending Sections 2-169 amd 2-170 of the
<br />City Code, deferred to the 17 September, 1974 meeting where it emerged as an amendment
<br />to Section 2-165, was rejected and substitute motion to redraft the entire Department
<br />of Public Safety section was passed by a 6-1 vote.
<br />
<br /> It is further requested that I be granted the privilege of addressing said item of
<br />business prior to its being acted upon by Council.
<br />
<br /> It is noted that the previous two ordinances drafted in this matter were inadvertrnt-
<br />ly not available to the writer or the press until meeting time and therefore could not be
<br />properly reported to Portsmouth citizens or intelligently addressed by the writer.
<br />
<br /> In view of the current situation wherein a new Chief of Police is in Office, the re-
<br />call action in lieu of bonafide political action has fizzled to its predestined course,
<br />and the viable status of the Department of Public Safety and specific responsibility for
<br />the discipline and direct suprcvision of Police and Fire personnel remain uncertain, any
<br />proposed change to the Code be a matter of full public knowledge and possible imput prior
<br />to Council action.

<br /> By copy of this letter the City Attorney is requested to advise.this writer as to the
<br />time an which a copy of said ordinance will be available."

<br /> Motion of Mr. Oast and seconded by Mr. Barnes to amend the ordinance in paragrFph 2
<br />by inserting after Section include 162; paragraph ~-B after word "finance" include"and/or
<br />representative designee", was approved on first reading, as amended, and by the following
<br />vote:

<br /> 74-301 - The following resolution, deferred from Council meeting of September 10,
<br />1974, was taken up and read:
<br />
<br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OF SOUTHERN
<br />AVENUE BETWEEN PAGE STREET AND HILL AVENUE.
<br />
<br /> WHEREAS, Portsmouth Terminals, Inc. has made application to vacate and close the
<br />hereinafter described portion of a certain street, and it appearing that notice of
<br />the application and request for the appointment of viewers was duly posted on the bulletin
<br />board of the Circuit Court of the City of Portsmouth, and in two other public places
<br />in said City, at least 10 days prior to October 8, 1974.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that Frank N. Bilisoly, Joseph C. Barber, Belvin W. Blachman, Zalmon I. Blachman and
<br />James L. Choate, be appointed viewers to view the hereinafter described portion of
<br />such street and report to this Council in writing, whether in their opinion, any, and
<br />if any, what inconvenience would result from vacating and closing the following:
<br />
<br /> All that certain lot or parcel of land situate in the City of Portsmouth,
<br /> Virginia, and described as follows:
<br />
<br /> Southern Avenue from its intersection with the center line of Page Street,
<br /> extended, six hundred and five (605) feet in a westerly direction to a line
<br /> approximately 75 feet east of the eastern right of way of Hill Avenue."

<br /> On motion of Mr. Holley and seconded by Mr. Wentz, the resolution was adopted and
<br />by the following ~ote: '
