381 <br /> <br />October 8, 1974 <br /> <br /> 74-419 - "Consideration of a resolution authorizing and directing the City Manage~ to <br />enter into an agreement with the Seaboard Coast Line Railroad Company for the operation <br />and maintenance of certain side track facilities near Godwin and South Streets. <br /> <br /> This agreement is to permit continued operation of the side track to municipal pro- <br />perty. The City Manager recommends adoption of this.resolution." <br /> <br /> On motion of Mr. Holley and seconded by Mr. Early, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO ENTER INTO AN <br />AGREBEMENT WITH THE SEABOARD COAST LINE RAILROAD COMPANY FOR THE OPERATION <br />AND MAINTENANCE OF CERTAIN SIDE TRACK FACILITIES OF SAID RAILROAD NEAR <br />GODWIN AND SOUTH STREETS. <br /> <br /> WHEREAS, it is necessary to continue to operate and maintain a certain side track <br />facility of the Seaboard Coast Line Railroad Company railway tracks at a location as <br />shown on a plat as attached hereto; and <br /> <br /> WHEREAS, it is necessary to enter into an agreement with the Seaboard Coast Line <br />Railroad Company with regard to the operation and maintenance of said side track facilitie <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the form of agreement between the City and the Seaboard Coast Line Railroad Company, <br />dated August 16, 1974, by the provisions of which the Railroad Company grants to the <br />City an easement or right of way and the City grants to the Railroad Company a certain <br />right of entry within the limits therein set out for the operation and maintenance <br />of certain side track facilities along the right of way and tracks of the Seaboard <br />Coast Line Railroad Company at Portsmouth, Virginia; and as more particularly described <br />in said agreement as attached hereto, be and the same hereby is approved. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized <br />and directed to execute said agreement in the name and on behalf of the City." <br /> <br />Ayes: Barnes, EArly, <br />Nays: None <br />Abstainimg: Oast <br /> <br />Elliott, Wentz, Davis <br /> <br /> 74-420 - "Consideration of a resolution authorizing and directing the City Manager <br />to execute an easement with Virginia Electric and Power Company for underground wiring <br />facilities and transformer to serve the Seawall Inn Restaurant located on Water Street <br />adjacent to the Lightship Museum. <br /> <br /> This agreement grants an easement for five years to VEPCO fo~ underground electrical <br />service from Water Street to the Lightship Museum and an additional 20 feet for a trans- <br />former pad to serve the property of Allan L. Segal. The City Manager recommends adoption <br />of this resolution." <br /> <br /> On motion of Mr. Early and seconded by Mr. Elliott, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AN <br />EASEMENT AGREEMENT ON BEHALF OF THE CITY OF PORTSMOUTH, GRANTING A RIGHT <br />OF WAY TO VIRGINIA ELECTRIC AND POWER COMPANY OVER A PORTION OF CITY <br />OWNED PROPERTY EAST OF THE INTERSECTION OF WATER STREET AND LONDON BOULEVARD. <br /> <br /> WHEREAS, Virginia Electric and Power Company, a Virginia Corporation, desires <br />to acquire an easement in order to maintain a right of wa~ over certain city owned proper' <br />located east of Water Street and London Boulevard for the purpose of transmitting and <br />distributing electric power by way of transformer and ground line connections; and <br /> <br /> WHEREAS, it <br />electric power to <br />of Portsmouth. <br /> <br />is the sense of Council that the facilitation of the distribution of <br />the residents of the City would be in the best interest of the City <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is, authorized and directed to execute any and <br />all documents connected with the attached easement granting a right of way over a portion <br />of certain city owned property located east of the intersection of Water Street and <br />London Boulevard to the Virginia Electric and Power Company." <br /> <br />Ayes: Barnes, Early, <br />Nays: None <br />Abstaining: Holley, Oast <br /> <br />Elliott, <br /> <br />Went~, Davis <br /> <br /> 74-421 "Consideration of a resolution authorizing the sUbmission of an amended <br />grant application to the Department of H~si-~g and Urban Development. <br /> <br /> The amendment to the grant application would delete plans for a reservoir and sub- <br />stitute improvements to the transmission and distribution main systems. The Department oJ <br />~ing ~a~U~b~n~evelop~entr~res that the local governing body certify its approval <br />of such change by resolution.
