<br /> 74-480 - "Consideration of a resolution authorizing and directing the City Manager to
<br />execute a license agreement between the City and the Seaboard Coast Line Railroad.
<br />
<br /> This agreement would permit the City of Portsmouth to construct and maintain a sewer
<br />main and a water main under the right-of-way of the Seaboard Coast Lin~ Railroad near the
<br />Elmhurst Lane crossing. The agreement includes provision for a $30 payment to the railroad
<br />to cover the cost of a survey and other expenses incurred in processing this matter. The
<br />City Manager reco~mmends adoption of this resolution."

<br /> On motion of Mr. Wentz and seconded by Mr. Elliott, the following resolution was
<br />adoFted, and by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING AND DIRECTING THE CITY ~NAGER TO EXECUTE A LICENSE
<br />AGREEMENT BETWEEN THE CITY OF PORTSMOUTH AND THE SEABOARD COAST LINE .RAILROAD
<br />COMPANY FOR THE CONSTRUCTION AND MAINTENANCE OF SANITARY SE~R PIPES AND WATER
<br />MAINS AT THE ELMHURST LANE STREET CROSSING.
<br />
<br /> WHEREAS, it is necessary to provide for a sanitary sewer line and water main at the
<br />Elmhurst Lane crossing of the Seaboard Coast Line Railroad Company railroad tracks; and
<br />
<br /> %~EREAS, it is necessary to enter into an agreement with the Seaboard Coast Line Rail-
<br />road Company in order to construct and maintain said sanitary sewer pipe and water main
<br />the aforementioned location.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Portsmouth, Virginia,
<br />that the form of the agreement between the City and the Seaboard Coast Line Railroad Company,
<br />dated October 21, 1974, by the provisions of which the Railroad grants to the City a license,
<br />within th~ limits therein set forth, for the construction and maintenance of a sanitary sewer
<br />line and water main under the right of way and tracks of the Seaboard Coast Line Railroad
<br />Company at the Elmhurst Lane street crossing; and as more particularly described in said
<br />agreement and as more fully shown on the plat attached to and made a part of said agreement
<br />as attached hereto, be, and the same hereby ~s approved.
<br />
<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized and
<br />directed to execute said agreemen~ in the name and on behalf of the City of Portsmouth."

<br />plus the cost of advertising. Mr. Hendricks' bid was the only bid submitted and was in
<br />the amount of $501. The City Manager recommends adoption of this resolution."

<br /> On motion of Mr. Barnes and seconded by Mr. Elliott, the following resolution was
<br />adopted, and by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING AND DIRECTING THE CITY }~NAGER TO ACCEPT THE BID OF
<br />MR. S~I HENDRICKS TO PURCHASE CERTAIN CITY-OWNED PROPERTY (432 LINCOLN STREET).
<br />
<br /> WHEREAS, the Council of the
<br />property, hereinafter described,
<br />purposes; and

<br />City of Portsmouth, Virginia, has determined that certain
<br />is surplus property and no longer required for City
<br />
<br /> WHEREAS, the Council has authorized and directed the City Manager to advertise this
<br />property for sale upon certain terms and conditions; and

<br /> WHEREAS, the City Manager has caused the said property to be advertised in accordance
<br />with the said authorization; and
<br />
<br /> F~EREAS, Mr. Sam Hendricks has submitted a bid in response to said advertisement, such
<br />bid being Five Hundred and One Dollars (~501.00) plus the cost of advertising and being the
<br />only bid received; and
<br />
<br /> ~EREAS, the Council finds, after due consideration, that the
<br />complies fully with the terms of the City's advertisement and will
<br />of the property on terms most favorable to the City.

<br />of approximately 120 feet and a width of 29 feet.

<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized and
<br />directed to execute all documents and complete all transactions incident to the conveyance
<br />of this property, subject to the terms and conditions of the City's advertisement of this
<br />property."
