48 <br /> <br />January' 28,1975 <br /> <br /> BE 1T FURTHER RESOLVED that the City Clerk be, and he hereby is, authorized and directed <br />to forward a certified copy of this resolution to the Department of Highways and Trans- <br />portation.'' <br /> <br />Ayes: Barnes, Early, Elliott, east, DAvis <br />Nays: None <br /> <br /> ~5-49 "Consideration of a resolution authorizing and directing the City Manager to <br />make application for permit for the Virginia Department of Highways to remove 518 feet of <br />wire fence that is used to mark the northern right-of-way of 1-264 between Greenwood Drive <br />and Victory Boulevard and to sign a bond in the amount of ~,000 for the project. <br /> <br /> This resolution authorized the City to remove the fence along the right-of-way in order <br />to complete the public improvements associated with the industrial access road (Elmhurst Lane <br />Extended) to accommodate the shared laundry. The City Manager recommends approval of this <br />resolution." <br /> <br />"A RESOLUTION DIRECTING THE CITY MANAGER TO MAKE APPLICATION FOR A PERMIT FROM <br />T~LB VIRGINIA DEPARTMENT OF HIGHWAYS AND TRANSPORTATION TO REMOVE 318' OF WIRE <br />FENCE THAT IS USED TO ~RK THE NORTHERN RIGHT-OF-WAY OF 1-264 BET~EN GREENWOOD <br />DRIVE AND VICTORY BOULEVARD IN THE CITY OF PORTSMOUTH, AN~ TO SIGN ~ BOND IN <br />THE AMOUNT OF $1,0OO.O0 FOR SAID PROJECT <br /> <br /> WHEREAS, it becomes necessary from time to time for the City of Portsmouth to obtain <br />permits from the Virginia Department of Highways to install, construct, reconstruct, maintain <br />and operate certain public works along, across, over and upon the highway system of Virginia; <br />and <br /> <br /> WHEREAS, expense, damage or injury may be sustained by the Commonwealth of Virginia <br />growing out of the granting to said City of Portsmouth by the Virginia Department of High- <br />ways of said permits for the work aforesaid; and <br /> <br /> WHEREAS, one of the conditions of such permit or permits is that the City of Portsmouth <br />shall indemnify the Commonwealth of Virginia against all damages and injuries to the highways <br />and bridges and to property lawfully upon such highways. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is directed to make application for a permit from <br />the Virginia Department of Highways and Transportation to install a forty-two inch reinforced <br />concrete storm drain and to sign a bond in the form attached hereto in the amount of One <br />Thousand and O0/tO0 ($1,OOO.OO) Dollars for the hereinabove mentioned project. <br /> <br /> BE IT FURTHER RESOLVED that the City Clerk is directed to forward a certified copy <br />of this resolution to Virginia Department of Highways and Transportation." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. east, the resolution was adopted, and by <br />following vote: <br /> <br />the <br /> <br />Ayes: Barnes, Early, Elliott, Oast, Davis <br />Nays: None <br /> <br /> 75-50 - "Submission of a report from the City Manager on the Comprehensive Employment <br />Training Act (CETA¢, and the City Manager's Quarterly Financial Report for the period ending <br />December 31, 1974. <br /> <br /> These reports are required by C6uncil policy." <br /> <br /> Motion of Mr. east and seconded by Mr. Barnes, the reports to be received as information <br />was adopted by unanimous vote. <br /> <br /> 75-51 "Consideration of an ordinance on first reading amending and reordaining <br />Section 20-8~ concerning the business license tax levied against fortune tellers, clair- <br />voyants, and practitioners of palmistry, phrenology, and handwriting analysis. <br /> <br /> This amendment reduces the business license tax of a fortune teller from $10,000 to <br />$1,000." <br /> <br /> On motion of Mr. Elliott and seconded by Mr~ Barnes, the following ordinance was approve <br />on first reading, and by unanimous ye%e: <br /> <br /> "A~ ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br /> BY ~4ENDING SECTION 20-85 THEREOF, PERTAINING TO A LICENSE TAX ON PERSONS <br /> ENGAGED AS FORT~NE-TELLERS AND CLAIRVOYANTS, AND PRACTITIONERS O~ PALMISTRY, <br /> PHRENOLOGY AND HANDWRITING ANALYSIS." <br /> <br /> ?5-SZ - "Consideration of an ordinance on first reading to appropriate $220,356 from <br />the General Fund for an expanded Public Service Employment Program. <br /> <br /> This ordinance will appropriate funds provided through the Department of Labor under <br />Title VI of the Comprehensive Employment amd Training Act~of 1975 as amended by the Emergency <br />Jobs Act of 1~74. These funds are designed to have an immediate impact on the unemployment <br />levels of the City through the creation of public service jobs~ The City Manager recommends <br />adoption of this ordinance on first reading." <br /> <br /> <br />
