75 <br /> <br />March il, 1975 <br /> <br /> 75-66 "Consideration of an ordinance on first reading appropriating $15,000 from <br />the Capital Improvement Fund £or engineering study to convert the incinerator to a 'Turbulent <br />Air-System'. <br /> <br /> On motion of Mr. Holley and seconded by Mr. Barnes, that the appropriation of $15,000 <br />to be approved on first reading, was adopted by unanimous vote. <br /> <br /> Motion of Mr. Oast and seconded by Mr. Elliott, that the City Manager be directed to <br />receive proposals for installing tile refractory baffles, was adopted by unanimous vote. <br /> <br />75-31 - Councilman Edward L. Oast, Jr. presented the following resolution: <br /> <br />"A REgOLUTION DIRECTING THE CITY MANAGER TO ESTABLISH BY JULY 1, 1975 A MEET <br />AND DISCUSS PROCEDURE WITH EMPLOYEES PERTAINING TO WAGES, HOURS AND CONDITIONS <br />OF EMPLOYMENT; DIRECTING THE CITY MANAGER TO REPORT TO COUNCIL EACH YEAR THE <br />SUBSTANCE OF SUCH DISCUSSIONS; COMMITTING THE COUNCIL TO CONSIDER THE SUBSTANCE <br />OF SUCH DISCUSSIDNS IN WEIGHING THE PUBLIC INTEREST DURING ANNUAL BUDGET <br />DELIBERATIONS.- <br /> <br /> WHEREAS, the A~torney General of the Commonwealth Of ¥irginimrules. on October 7, <br />1974 that "local units of government may not enter into collective bargaining agreements <br />absent express statutory authority from the General Assembly"; amd <br /> <br /> WHEREAS, this Council did on October 8, 1974 request the General Assembly of the <br />Commonwealth of Virginia to clarify and define the powers, rights, duties and responsibiliti~ <br />of Virginia localities in the area of public employee labor relations; and <br /> <br /> I~4EREAS, the General Assembly of the Commonwealth of Virginia refused to take such <br />action; and <br /> <br /> WHEREAS, there continues to be no direct or implied power authorizing municipal <br />corporations of Virginia to recognize employee labor organizations and/or to enter into <br />the procedures of collective bargaining; and <br /> <br /> WHEREAS, this Council recognizes that the trusted public servants of the City of <br />Portsmouth seek and deserve the right to discuss their conditions of employment with <br />management; and <br /> <br /> ¥~EREAS, this Council has heretofore established a procedure for the hearing of <br />individual grievances. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 12~r Tha~fi~ the City Manager is directed to establish by July 1, 1975 a procedure whereby <br />persons delegated by the City Manager shall each year meet and discuss wages, hours and <br />conditions of employment with employees prior to submitting his budget recommendation <br />to City Council. <br /> <br /> 2. That the City Manager is directed to report to the City Council the substance <br />of such discussions in the form of a report prior to submission of his annual budget <br />recommendation. <br /> <br /> 3. That this Council shall consider the substance of such discussions in weighing <br />the public interest during annual budget deliberations." <br /> <br /> On motion of Mr. Oast and seconded by Mr. Holley, the resolution was adopted, and by <br />the following ~te: <br /> <br />Ayes: Barnes, Early, Holley, Oast, Wentz, Davis <br />Nays: Elliott <br /> <br />The following recommendations by the City Manager were presented: <br /> <br /> 75-104 - "Consideration of an ordinance on first reading to appropriate $4,000 from the <br />Capital Improvement Fund for the construction of an oil storage building at the City Garage. <br /> <br /> The Construction of an oil storage building is required under the Federal and State <br />Occupation Safety Hazard Act. This item was included in the 1974-75 Capital Improvements <br />Work Plan in Public Building Improvements. The City Manager recommends adoption of this <br />ordinance on first reading. <br /> <br /> On motion of Mr. Oast and seconded by Mr. Elliott, <br />on first reading, and by unanimous vote: <br /> <br />the <br />for <br /> <br />the following ordinance was approved <br /> <br /> "AN ORDINANCE TO APPROPRIATE $4,000 FROM THE CAPITAL IMPROVEMENT FUND FOR <br /> CONSTRUCTION OF AN OIL STORAGE BUILDING AT THE CITY GARAGE." <br /> <br /> 75-105 "Consideration of an ordinance on first reading to appgopriate $17,500 from ' <br />Capital Improvement Fund for the architectural and engineering design of the Master Plan <br />the Churchland Park. <br /> <br /> This project was added in the 1975-75 Capital Work Plan in the category of Parks and <br />Recreation. Authorization to select an architectural and engineering firm was previously <br />approved by the City Council and this appropriation provides funds for the fees for the <br />planning and design.¥ <br /> <br /> <br />
