<br /> WHEREAS, advancement of the work and use of said project will be delayed unreason-
<br />ably if the said property is not made available as soon as possible.

<br /> NOW, THEREFORE, BE IT RESOLVED by the .Council of the City of Portsmouth, Virginia:
<br />
<br /> 1. The City Attorney is directed to institute eminent domain proceedings, employ-
<br />ing spegial counsel for that purpose if he deems it advisable, against the following
<br />property situate in the City of Portsmouth, for the purpose of acquiring.fee simple
<br />title therein, together with any and all easements of access, light or amr incident
<br />to the lands of the landowner abutting upon said property, in accordance with and
<br />pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth
<br />(Chapter 471 of the Acts of Assembly of 1970), and to deposit to the credit of the
<br />court as provided by law the sum hereafter specified to compensate Naomi Johnson
<br />and Willie Johnson, or if any of the above named defendants be not living, then their
<br />heirs or devisees together with any and all other persons, known or unknown, who may
<br />have an interest, right, title or claim in and to the property sought to be condemned,
<br />who are the owners or who have an interest therein of the hereinafter described property
<br />

<br />2. The property to be acquired hereunder is described as follows:

<br /> An undivided one-half interest in all that certain lot or parcel
<br /> of land situate in the City of Portsmouth, Virginia, and known,
<br /> numbered and designated as Lot Number Forty-seven (47), as shown
<br /> on the plat of Pinners Point Home Company, of record in the office
<br /> of the Clerk of the City of Chesapeake, Virginia, in Map Book 4,
<br /> at page 12.

<br />5. The amount of money to be deposited with the Court is $550.00."

<br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY TIlE
<br />CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT
<br />TO CHAPTER 471 OF'THE ACTS OF ASSEMBLY OF 1970, SAID PROPERTY BEING
<br />NECESSARY .FOR THE CONSTRUCTION OF A FIRE STATION BOUNDED ON Tt~ WEST
<br />BY LEE AVENUE, ON THE EAST BY INDUSTRIAL AVENUE AND ON THE SOUTH BY
<br />CLEVELAND STREET IN THE CITY OF PORTSMOUTH.

<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest
<br /> hereinafter specified in and to the hereinafter described parcel of land situate in
<br /> the City of Portsmouth, Virginia, for the purpose of constructing a Fire Station; and
<br />
<br /> W}tEREAS, the City of Portsmouth has not been able to purchase the property describe~
<br /> herein, necessary to the project, because the.owners thereof, and the City have not been
<br /> able to agree upon the price to be paid therefor, or the City has not been able to
<br /> locate certain of the owners or because of the status of the title of the property;
<br /> and
<br />

<br /> Elizabeth McAllister, Claudia Bell Howard, Lula Mae Brown and Callie R. McRae, or if
<br /> any of the above named defendants be not living, then their heirs or devisees together
<br /> with any and all other persons, known or unknown, who may have an interest, right, title
<br /> or claim in and to the property sought to be condemned, who are the owners or who have
<br /> an interest therein of the hereinafter described property.

<br /> All that certain lot or parcel of land, situate in the City of Portsmouth,
<br />Virginia, and known, numbered and designated as Lot Number Fifty-one (51)
<br />as shown on the plat of Pinners Point Home Company, of record in the office
<br />of the Clerk of the Circuit Court of the City of Chesapeake, Virginia,
<br />in Map Book 4, at page 12.

<br />The amount of money to be deposited with the Court is $5100.00."
