The amount of money to be deposited with the Court is $1100.00." <br /> <br />: Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br /> - Nays: None <br /> <br /> an motion of Mr. Wentz and seconded by Mr. Elliott, the following resolution was adopted <br />and by the following vote: <br /> <br />(b) <br /> <br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE <br />CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT <br />TO C}~PTER 471 OF THE ACTS OF ASSEMBLY OF 1970, SAID PROPERTY BEING <br />NECESSARY FOR THE CONSTRUCTION OF A FIRE STATION BOUNDED ON THE WEST <br />BY LEE AVENUE, ON THE EAST BY INDUSTRIAL AVENUE AND ON THE SOUTH BY <br />CLEVELAND STREET IN THE CITY OF PORTSMOUTH. <br /> <br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest <br />hereinafter specified in and to the hereinafter described parcel of land situate in <br />the City of Portsmouth, Virginia, for the purpose of constructing a Fire Station; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase the property describe <br />herein, necessary to the project, because the owners thereof and the City have not <br />been able to agree upon the price to be paid therefor, or the City has not been able <br />to locate certain of the owners or because of the status of the title of the property; <br />and <br /> <br /> WHEREAS, advancement of the work and use of said project will be delayed unreason- <br />ably if the said property is not made available as Soon as possible. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council Of the City of Portsmouth, Virginia: <br /> <br /> 1. The City Attorney is'directed to institute eminent domain proceedings, <br />special counsel for that purpose if he deems it advisable, against the following propert <br />situate in the City of Portsmouth, for the purpose of acquiring fee simple title there- <br />in, together with any and all easements of access, light or air incident to the lands <br />of the landowner abutting upon said property, in accordance with and pursuant to <br />Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 <br />of the Acts of Assembly of 1970), and to deposit to the credit of the court as provided <br />by law the sum hereafter specified to compensate Carrie Lee McQueen and Georgianna <br />McQueen a/k/a Georgianna McQueen Jones, or if any of the above named defendants be <br />not living,, then their heirs or devisees together with any and all other persons, known <br />or unknown, who may have an interest, right, title or claim in and to the property <br />sought to be condemned, who are the owners or who have an interest therein of the here- <br />inafter described property. <br /> <br />2.
