177 <br /> <br />August 12, 1975 <br /> <br /> On motion of Mr. Early and seconded by Mr. Holley, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION DIRECTING THE TREASURER OF THE CITY OF PORTSMOUTH TO REFUND <br />$9,6S6.7S TO FINANCEAMERICA AS A RESULT OF AN ERRONEOUS ASSESSMENT. <br /> <br /> ~EREAS, the Commissioner of Revenue of the City of Portsmouth has certified to <br />this Council that FinanceAmerica has been erroneously assessed in the amount of Nine Thousand <br />Six Hundred Fifty-six and 75/100 ($9,656.75) Dollars because of incorrect information furnish. <br />by FinanceAmerica to the Commissioner of Revenue; and <br /> <br />WHEREAS, the City Attorney has consented that such assessment was erroneous. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Portsmouth that the City <br />Treasurer is directed to refund Nine Thousand Six ttundred Fifty-six and 75/1OO ($9,656.75) <br />Dollars without interest to FinanceAmerica for an erroneous assessment caused by FinanceAmeri <br />incorrect reporting of revenuesf" <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 75-336 "Consideration of a resolution endorsing <br />Security Act; and opposing the proposed State plan for <br />and formula distribution. <br /> <br />the concept of Title XX of the Social <br />services pertaining to eligibility <br /> <br /> This resolution endorses the concept of services required by Title XX of the Social <br />Security Act which is scheduled to become effective on October 1, 1975. However, it opposes <br />the current State plan for determining eligibility for services under Title XX and the pro- <br />posed allocation of funds based on population alone with no consideration given to need. <br />The Citizens Advisory Committee has reviewed the proposal and a copy of their recommendations <br />is attached for your information. The City Manager recommends adoption." <br /> <br /> On motion df Mr. Barnes and seconded by Mr. Early, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION ENDORSING THE CONCEPT OF TITLE XX OF THE SOCIAL SECURITY ACT; <br />OPPOSING TF~ DEPART}4ENT OF WELFARE'S PROPOSED COMPREHENSIVE PLAN FOR IMPLEMENTATION <br />OF TITLE XX. <br /> <br /> WHEREAS, Title XX of the Social Security Act has been amended and will be implemented <br />on October 1, 1975; and <br /> <br /> W~EREAS, said Title X× is directed at five (5) national goals pertaining to welfare rec~ <br />pients: Self support; self sufficiency, prevenzing or remedying abuse, neglect or exploitatioi <br />preventing institutionalization; and securing institutional care when necessary; and <br /> <br /> ~{EREAS, a proposed Comprehensive Plan has been developed by the Department of Welfare <br />of the Commonwealth of Virginia to implement Title XX concerning eligibility recipients <br />and allocation of funds; and <br /> <br /> WHEREAS, the Citizens Advisory Commission has considered such 'proposed comprehensive <br />plan and made recommendations pertaining thereto. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that it endorses <br />the expansion of Social Services provided in Title XX of the amended Social Security Act. <br /> <br /> BE IT FURTHER RESOLVED that the Council strongly urges the Department of Walfare to <br />amend its Comprehensive Plan for providing the expanded social services provided in Title <br />XX as follows: <br /> <br /> a. Rather than allocate funds based upon total population, funds should be allocated <br />based upon proven experience of total expenditures in the ten (10) major catagories of <br />assistance covering the period of time from July 1, 1974 to March 31, 1975. <br /> <br /> b. Eligibility of person should be fixed at forty (40%) percent of the median state <br />income rather than as proposed at sixty (60%) percent because of fiscal restraints in the <br />number of persons who would be eligible for such increased services. <br /> <br /> c. State agencies and state agency vendor contracts should not be funded under Title <br />XX as these funds were intended for local use and determination. <br /> <br /> d. Cities of One Hundred Thousand (100,000,OO0) population should be placed in individ- <br />ual planning areas as opposed to the proposed use of planning districts; planning districts <br />contain local jurisdictions much too different in total need in kinds of Social Services. <br /> <br />to pay. <br /> <br />Fees for Social Services rendered should be based upon the ability of the recipient <br /> <br /> BE IT FURTHER RESOLVED that a copy of this resolution be forwarded by the City Clerk <br />to all appropriate authorities.' <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, We~tz, Davis <br />Nays: None <br /> <br /> 75-337 - "Consideration of a resolution strenuously urging the Governor of the Common- <br />wealth of Virginia to request the State Division of Economic Development to participate in <br /> <br />d <br /> <br />a~s <br /> <br /> <br />
