April 27, 1999 <br /> <br />(b) All signage and exterior renovations must be approved by the <br /> Downtown Design Committee prior to commencement of construction. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />99 -100 - Adoption of an ordinance to bring Section 35-4 of the Code of the City of <br />Portsmouth entitled Interest on Delinquencies into compliance with the Personal <br />Property Relief Act of 1998. <br /> <br />No interest may be imposed on any amount of the delinquent personal <br />property tax to be paid by the Commonwealth. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend Section 35-4 of the Code of the City of <br />Portsmouth pertaining to interest on delinquencies. <br /> <br />Purpose and Need: <br /> <br />· As a result of the Personal Property Tax Relief Act of 1998, beginning in tax year <br />1999, if taxpayers fail to make payment by the due date, no interest may be imposed on <br />the amount to be paid by the Commonwealth. <br /> <br />· The interest shall be calculated on the principal tax, plus penalty on the full amount <br />of the Tangible Personal Property Tax levied, less the applicable Tax Credit. <br /> <br />Financial Impact: <br /> <br />· The result of this action will be loss of interest on the "gross tax" if a taxpayer fails to <br />pay by his/her due date. <br /> <br />· The financial impact is unknown at this time. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 35 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 35-4 PERTAINING TO <br />INTEREST ON DELINQUENCIES." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />99 - 101 - Adoption of a resolution authorizing the City Manager to vacate and convey <br />an inactive 15 foot wide right-of-way across Pitchkettle Farms in Suffolk, Virginia in <br />return for a 20 foot wide easement across Pitchkettle Farms and parallel to Pitchkettle <br />Road (State Route 604). <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution authorizing the City Manager to vacate and convey an <br />inactive 15 foot wide right-of-way across Pitchkettle Farms in Suffolk, Virginia, in return <br />for a 20 foot wide easement across Pitchkettle Farms and parallel to Pitchkettle Road <br />(State Route 604). <br /> <br />Purpose and Need: <br /> <br />· Portsmouth's current 15 foot right-of-way dates to 1916 and contains three water <br />lines that have been inactive and abandoned since the construction of the Lake Meade <br />reservoir in 1962. This right-of-way bisects Pitchkettle Farms and precludes the <br />development of this property as a residential subdivision. <br /> <br /> <br />
