April 27, 1999 <br /> <br />· The owner of this property has proffered to dedicate a 20 foot wide easement along <br />the front of Pitchkettle Farms that would adjoin and parallel Pitchkettle Road in <br />exchange for Portsmouth's conveyance and abandonment of its 1916 right-of-way. <br /> <br />· The proffered 20 foot easement fronting a state road is preferred by the Department <br />of Public Utilities for future use as it is more accessible than the existing 15 foot wide <br />right-of-way that bisects and is inside the farm. <br /> <br />· The right-of-way that Portsmouth would abandon and convey is 34,117 square feet <br />in area and the 20 foot easement to be obtained, in trade, by Portsmouth would be <br />56,226 square feet in area. <br /> <br />· The owner of Pitchkettle Farms would bear the entire expense of preparing all the <br />necessary legal documents, surveys and plats to effect this land trade. <br /> <br />· Acceptance of this proffer sets the stage for similar favorable land exchanges with <br />Portsmouth from other Suffolk land owners where Portsmouth's 15 foot wide right-of- <br />way crosses their property. Portsmouth would prefer an easement fronting a state road <br />for future use. <br /> <br />Financial Impact: <br /> <br />· There is no financial impact. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Moody, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE AND VACATE <br />A PORTION OF AN ELECTRICAL TRANSMISSION AND RAW WATER MAIN RIGHT <br />OF WAY LOCATED IN THE CITY OF SUFFOLK, VIRGINIA TO PITCHKETTLE <br />FARMS, L.L.C. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City <br />Manager be, and he hereby is, authorized to release and vacate that portion of an <br />electrical transmission and raw water main right of way to Pitchkettle Farms, L.L.C. over, <br />under and across a strip of land from its point of intersection with the southwest corner <br />of Lake Kilby Road and Pitchkettle Road to the point where said right of way intersects <br />the western line of that property now owned by Pitchkettle Farms, L.L.C., which said <br />land will be shown and designated on plats and exhibits to be recorded in the Clerk's <br />Office of the Circuit Court of the City of Suffolk, Virginia for a more particular description <br />of the right of way to be released and vacated. <br /> <br /> Be it further resolved that the City Manager is authorized to execute such plats, <br />deeds or other documents as may be necessary to give effect to this resolution, and as <br />he shall deem appropriate and in the best interest of the City of Portsmouth." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />99 - 102 - Adoption of the following ordinances recommending the proposed operating <br />budget for fiscal year ending June 30, 2000. <br /> <br />a. Adoption of an ordinance to re-establish the tax rates on real estate, tangible <br />personal property, privately owned pleasure boats, privately owned camping trailers and <br />motor homes and machinery and tools. <br /> <br />Adoption of an ordinance to amend Chapter 38 of the Code of the City of <br />Portsmouth pertaining to water service charges and sewage disposal charges into <br />the City sewer system. <br /> <br />Water service charges are proposed to increase from the present $2.15 <br />per 1000 gallons to $2.50 per 1000 gallons. In addition, the charge for <br />sewage disposal is proposed to increase from $1.4973 per gallons of water <br />usage to $1.81 per 1000 gallons of water usage. <br /> <br /> <br />
