REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Griffin, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />99- 85(b): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO NORMAN T. MALBON FOR THE <br />OPERATION OF A PIANO SALES/SERVICE ESTABLISHMENT AT 233 HIGH <br />STREET. <br /> <br /> WHEREAS, Norman T. Malbon has made application pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use <br />permit to operate a piano sales/service establishment at 233 High Street, Portsmouth, <br />Virginia, as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of said <br />use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br /> working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Is compatible with and will not adversely affect or be materially <br />detrimental to adjacent uses, residents, buildings, structures, or natural <br />resources; <br /> <br /> (d) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (e) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic <br />movement; and <br /> <br /> (f) Will be in accordance with the purposes of the City of Portsmouth <br />Zoning Ordinance. <br /> <br /> 2. That Norman T. Malbon is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a <br />piano sales/service establishment at 233 High Street, being more particularly described <br />as: <br /> <br />UP-99-07 <br /> <br /> Beginning at a point 278.70'+ west of <br />the southwest corner of High Street and <br />Crawford Street; thence, west 74.66'+ to a <br />point; thence, south 113'+ to a point; thence, <br />east 74.24'+ to a point, thence, 113'+ to the <br />point of the beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) Use of the property is limited to a piano sales/service establishment. <br /> <br /> <br />
