April 27, 1999 <br /> <br /> WHEREAS, the applicants and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of said <br />use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Is compatible with and will not adversely affect or be materially <br />detrimental to adjacent uses, residents, buildings, structures, or natural <br />resources; <br /> <br />(d) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br />(e) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic <br />movement; and <br /> <br />(f) Will be in accordance with the purposes of the City of Portsmouth <br />Zoning Ordinance. <br /> <br /> 2. That Charles and Brenda Honeycutt are hereby granted a use permit <br />pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for <br />the conversion of an existing non-residential structure into a two-family dwelling at 320 <br />Middle Street, being more particularly described as: <br /> <br />UP-96-06 <br /> <br /> Beginning at a point approximately 210 <br />feet from the northwestern intersection of North <br />Street and Middle Street thence west 115.5 <br />feet to a point; thence north approximately 85 <br />feet to a point; thence east approximately 150 <br />feet to a point; thence south 79.1 feet to a <br />point; thence west approximately 28 to a point; <br />thence south approximately 5 feet along the <br />southwestern right-of-way line of Middle Street <br />to the point of beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) <br /> <br />The applicants shall convert the non-residential structure into a two- <br />family dwelling in accordance with the floor and elevation plans, <br />identified as Exhibits A and B, attached hereto and made a part hereof. <br />The Director of Community Quality and Planning Services may <br />approve minor modifications to the plans. <br /> <br />(b) All exterior renovations must be approved by the Commission of <br /> Architectural Review prior to construction. <br /> <br />(c) The applicants shall obtain a waiver from the Board of Zoning Appeals <br /> prior to the issuance of the building permit. <br /> <br />(d) The applicants shall be responsible for the cost of public utility <br /> upgrades required for the project. <br /> <br />(e) All taxes owed on the subject property shall be paid when due. <br /> <br /> <br />
