The City Attorney is directed to institute eminent domain proceedings against <br />the following property situate in the City of Portsmouth, for the purpose of acquiring <br />fee simple title therein, together with any and all easements of access, light or air <br />incident to the lands of the landowner abutting upon said property, in accordance and <br />pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter <br />471 of the Acts of Assembly of 1970, as amended), and to deposit to the credit of the <br />Clerk of the Circuit Court of the City of Portsmouth as provided by law the sum hereinafter <br />specified to compensate the owners of the parcel of land kno~m, numbered and designated <br />as Parcel 3 as shown on that certain plat entitled "Property To Be Conveyed To City <br />Of Portsmouth For Mt. Herman Conservation And Development Project VAR-69V, dated July <br />25, 1975, made by Baldwin & Gregg, Ltd., reference to said plat being made for a more <br />particular description of the property. A copy of said plat is attached hereto. <br /> Owner North American Acceptance Corporation and amount to be paid <br /> <br /> Name of the property <br />$35.00." <br /> <br />Ayes: Barnes, Early, Elliott, Holiey, Oast, Davis <br />Nays: None <br />Abstaining: Wentz <br /> <br /> 75-438 "Consideration of a resolution authorizing acquisition of certain property <br />under eminent domain proceedings located and widening of Wool Avenue. <br /> These resolutionszare necessary for the construction, alteration and widening of Wool <br />Avenue in connection with the Mount Hermon Conservation and Redevelopment Project. The City <br />Manager recommends adoption." <br /> <br /> On motion of Mr. Elliott and seconded by Mr. Early, the following <br />and by the following vote: <br /> <br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY <br /> OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER <br /> 471 OF THE ACTS OF ASSEMBLY, AS ~MENDED, SAID PROPERTY BEING NECESSARY FOR <br /> THE CONSTRUCTION, ALTERATION AND WIDENING OF WOOL AVENUE. <br /> <br /> WHEREAS, the City of <br />after specified in and to <br />of Portsmouth, Virginia, <br />Avenue. <br /> <br />resolution was adopted <br /> <br />Portsmouth has found it necessary to acquire the interest herein- <br />the hereinafter described parcel of land situate in the Cit~ <br />for the purpose of constructing, altering and widening Wool <br /> <br />the property described <br />to the property in that <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase <br />herein, necessary to the project, because of%a defect in the title <br />the present record owners cannot be located; and <br /> <br /> WHEREAS, advancement of the work and use of said project will be delayed <br />if said property is not made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br /> <br />unreasonably <br /> <br />the extension of the water main <br />recommends adoption." <br /> <br />and <br /> <br />permit from the State Highway Department to install a 16-inch water main in the proposed <br />interchange of West Norfolk Re~d and Route 164. <br /> <br /> This authorization is necessary to get a permit from the State Highway Department for <br /> from Coast Guard Boulevard to Port Norfolk.
