'225 <br /> <br />October i4, 1975 <br /> <br /> WHEREAS, it becomes necessary from time to time for the City of Portsmouth to obtain <br />permits from the Virginia Department of Highways to install, construct, reconstruct, <br />maintain and operate certain public works along, across, over and upon the highway system <br />of Virginia; and <br /> <br /> WHEREAS, expense, damage or injury may be sustained by the Commonwealth of Virginia <br />growing out of the granting to said City of Portsmouth by the Virginia Department of <br />Highways of said permits for the work aforesaid; and <br /> <br /> WHEREAS, one of the conditions of such permit or permits is <br />shall indemnify the Commonwealth of Virginia against all damages <br />highways and bridges and to property lawfully upon such highways. <br /> <br />that the City of Portsmouth <br />and injuries to the <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of tile City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is directed to apply for a permit from the Virginia <br />Department of Highways to install a sixteen inch ductile iron water main and to sign <br />a bond in the form attached hereto in the amount of One Thousand and OO/100 ($1,OO0.) <br />Dollars, for the hereinabove mentioned project." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 75-440 - "Consideration of a resolution authorizing the City Manager to do whatever <br />is necessary to institute a project to replace and repair deteriorated sidewalks, curbs <br />and gutters in certain~nsus tracts in conjunction with the Economic Development Administra- <br />tion. <br /> <br /> The City of Portsmouth has received a grant from EDA in the amount of $300,000 to be <br />matched by the City of Portsmouth contributing $50,000 in cash and $50,000 in in-kind service <br />for the purpose of replacing and repairing deteriorated sidewalks, curbs and gutters. This <br />project will significantly improve the appearance and utility of the sidewalks, curbs and <br />gutters in the neighborhoods involved. The City Manager recommends adop~i6n." <br /> <br /> On motion of Mr. Elliott and seconded by Mr. Barnes, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO INSTITUTE A PROJECT <br />TO REPLACE AND REPAIR DETERIORATED SIDEWALKS, CURBS, AND GUTTERS IN CENSUS TRACTS <br />102, 118, 119, 120 AND 125 IN CONJUNCTION WITH THE ECONOMIC DEVELOPMENT ADMINI- <br />STRATION OF THE U. S. DEPARTMENT OF COMMERCE. <br /> <br /> %CHEREAS, the Economic Development Administration of the U. S. Department of Commerce <br />has made certain funds available to support a labor intensive sidewalk, curb, and gutter <br />repair project in census tracts 102, 118, 119, 120 and 123; and <br /> <br /> WHEREAS, the City Manager has recommended institution of the project within the <br />city; and <br /> <br /> WHEREAS, it is the sense of the City Council of the City of Portsmouth, Virginia, <br />that such project would significantly contribute to upgrading the appearance and utility <br />of sidewalks, curbs and gutters in the neighborhoods involved; and <br /> <br /> WHEREAS, the City of Portsmouth would have undertaken this project during fiscal <br />year 1977 if sufficient funds had been available; and <br /> <br /> WHEREAS, the amount of federal funds to be provided will be Three Hundred Thousand <br />($5OO,OO0.) Dollars cash, to be matched by the City of Portsmouth in the amount of Fifty <br />Thousand ($50,OOO.) Dollars cash, and Fifty Thousand ($50,000.) Dollars in-kind services, <br />with the Fifty Thousand ($50,000.) Dollars cash being contingent on the receipt of federal <br />funds; and <br /> <br /> W-HEREAS, the Economic Development Administration requests assurances of completion <br />of the project in a timely and satisfactory manner within the approved budget constraint. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the City Manager on behalf of the City of Portsmouth is directed and authorized <br />to institute a project to replace and repair deteriorated sidewalks, curbs, and gutters <br />in census tracts 102, 118, 119, 120 and 123 in conjunction with the Economic Development <br />Administration of the U. S. Department of Commerce, such project to begin within sixty <br />(60) days after notification of receipt of the grant and to be completed within ten (10) <br />months. <br /> <br /> IT IS FURTHER RESOLVED that the City of Portsmouth will successfully complete the <br />project in a timely manner to_the satisfaction of Economic Development Administration <br />and that the City of Portsmouth will promptly pay ali amounts due and that the City will <br />either complete construction within the amount of the approved construction line item, <br />plus such change orders as are approved by the Economic Development Administration, or <br />that the City will provide any additional funds needed to successfully complete the project <br />in a timely manner." <br /> <br />Ayes: Barnes, Early, Elliott,~Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> <br />
