The City has submitted the content of tis ordinance to the State and <br />received approval. The City Manager recommends adoption. <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Elliott, ~ adopt the following on first and <br />final readingi <br /> <br /> 'AN ORDINANCE TO AMEND ARTICLE II, Chapter 32 OF THE CODE OF THE CITY OFPORTS- <br /> MOUTH, VIRGINIA, 1973, BY ADDING SECTIONS 32-60.1, 32-60.2, 32-60.4, 32-60.5, <br /> $2-60.6, 32-60.?, S2-60.8, 32-60.9, 32-60.10, 32-60.11, 32-60-12, 32-60.13, 32 <br /> 32-60.14, AND 32-60.1S THERETO, ALL SUCH SECTIONS PERTAINING TO EROSION AND <br /> SEDIMENT CONTROL." <br />* See below <br /> Substitute motion of Mr. Early and seconded by Mr. Barnes, the ordinance to be <br />was adopted by unanimous vote. <br /> <br />tabled, <br /> <br />* Mr. Benjamin J. Such bonds will be for the protection of the City <br />and persons for whom services are being provided to insure professional quality. The City <br />Manager recommends adoption. <br /> <br /> On Notion of Mr. Barnes and seconded by Mr. Holley, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY <br />AMENDING SECTION 6-13 OF SAID COBE BY ADDING THERETO A NEW SUBSECTION NUMBERED <br />6-13C4)(b) PERTAINING TO BONDS OF MASTER PLUMBERS AND BY AMENDING SECTION 6-18 <br />OF SAID CODE PERTAINING TO CONTRACTORS LICENSE AND BOND REQUIREMENTS." <br /> <br />Ayes: Barnas, Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 75-429 'Consideration of an ordinance to amend the City Code by repealing a section <br />of the license tax for manufacturer's sales agents. <br /> <br /> There appears in the City Code two conflicting sections pertaining to a City license <br />tax for manufacturer's sales agents. Tb~ section which we recommend to be repealed charges <br />a flat rate of $75 while the remaining section charges on a percentage basis consistent with <br />other business licenses. This amendment will eliminate the duplication in the City Code. <br />The City Manager recommends adoption." <br /> <br /> Motion of Mr. Elliott and seconded by Mr. Barnes, to suspend the rules for Attorney <br />Benjamin J. Levy, to s~eak, was adopted by unanimous vote. <br /> <br />Mr. Levy, spoke against. <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Early, to amend the ordinance by making the <br />effective date thirty (30) days from date ofradoption; and to adopt the following ordinance <br />on first and final reading, was adopted by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUth, VIRGINIA, 1973, <br />~ REPEALING THE EXISTING SECTION 20-89 OF CHAPTER 20 THEREOF, PERTAINING <br />TO LICENSE FOR MANUFACTURER'S SALES ABENTS." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br />75-430 "Consideration of an ordinance closing a portion of Fairfax Avenue. <br /> <br /> By resolution adopted September 9, 1975, viewers were appointed an RR~e recommended <br />that this street be closed.
