236 <br /> <br /> 75-463 "Sanitary sewers have been installed in the Rivershores area; however, tile area <br />west of Twin Pines Road requires pumping facilities to provide service. Original plans were <br />to connect this area to the proposed Ballard P.U.D. pumping Station. Delays in development <br />of the Ballard P.U,D. have required consideration of alternative methods of serving this <br />area. <br /> <br /> Dr. C. M. G. Buttery has previously indicated that a serious problem exists with several <br />septic tanks in this area and immediate action was recommended to make sanitary sewer service <br />available. Accordingly, a small pumping facility to be constructed in a manhole type structu <br />was designed. The City Attorney has advised that, although plans for such facilities are <br />normally submitted for approval to the State Health Department ~and State Water Control Board <br />prior to construction, the City may take immediate action to correct a public health problem. <br />On October 14, 1~75,. the following bids were opened for the proposed pumping facility: <br /> <br />Lineberry Construction Company <br />Van de Riet Construction Company <br />A. The balance from <br /> $10,830.6 <br /> <br />and <br />facilities in the amount of $5,000.00. <br />original appropriations for Rivershores Road sewers is $9,313.40, and an additional <br />is required to fund the City share Of the pumping facility and force main. <br /> It is requested that City Council take the following action: <br /> 1. Appropriate $11,000 from unappropriated Utility Bond <br /> proceeds to the Rivershores Road sewers~project [08F~8008~8~8). <br /> 2. Authorize award of the contract to the low bidder, Lineberry <br /> Construction Company. <br /> 5. Authorize the City Manager to enter into agreement with the <br /> Rivershore Point Corporation providing for their participation <br /> .in the ~ount bf $5,000.00." <br /> on motion of Mr. Barnes and seconded by Mr. Early, the following ordinance was approved <br />on first reading, and by 5,t-(~en~m-abstaining) vote: <br /> <br /> "AN ORDINANCE TO APPROPRIATE $11,000 FROM TIlE CAPITAL IMPROVEMENT FUND FOR <br /> THE EXTENSION OF SANITARY SEWERS AND PARTIAL COST OF A PROPOSED PUMPING <br /> STATION IN THE RIVER SHORES AREA." <br /> <br /> Motion of-Mr. Barnes and seconded by Mrs. Early, that the City Manager be authorized to <br /> enter into an_agreement with the River Shore Point Corporation, was adopted by 5~1 {Wentz- <br /> abstaining) vote. <br /> <br /> 75-464 - "Consideration of an ordinance on first reading to appropriate $26,400 in the <br /> Capital Improvement Fund for the updating of traffic signals at various locations in the <br /> City. <br /> <br /> :.This appropriation will provide the necessary funds to purchase additional controllers, <br /> walk lights on High Street to improve traffic flow, and new cross~alkyilluminating signs <br /> for Maryv~6w Hospital. The t97~-76 Capital~Improvement Budget has allocated $40,000 for <br /> 1975-76 for the updating of traffic signals throughout the City. The City Manager recommends <br /> adoption on first reading." <br /> <br /> Mayor Davis vacated the Chair to Vice Mayor Wentz,. to preside o~ this Item. <br /> On motion of Mr. Barnes and seconded by Mr. Elliott, the following ordinance was approved <br /> on first reading,, and by ~-1 (Davls-abstalnl g) vote: <br /> "AN ORDINANCE TO ~APPROPRIATE $2~.,400 FROM THE. CAPITAL IMPROVF31ENT FUND FOR <br /> DATING OF TRAFFIC SIGNALS AT VARIOUS LOCATIONS tN THE CITY." <br /> ~ 75-465~- "Consideration of an ordinance to amend the City Code by adding a section per- <br /> taining to resisting arrest and providing.penalties therefor. <br /> This ordinance and the two following ordinances were inadvertently left out during the <br /> recent recodification of Chapter 21 of the City Code. These sections had previously been <br /> miscellaneous offenses and should be reenacted and made a part of the City's criminal code. <br /> The City Manager recommendg adoption." <br /> On motion of Mr. Barnes and seconded by Mr. Early, the following ordinance was adopted <br /> on first and final reading, and by the following vote: <br /> <br /> "AN ORDINANCE TO AiqEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA,.1973, <br /> BY ADDING SECTION 21-180 TO CHAPTER 21 THEREOF, PERTAINING TO RESISTING <br /> ARREST AND THE PENALTIES THEREFOR." <br /> <br />'e <br /> <br /> <br />
