278 <br /> <br />January 15, 1973 <br /> <br /> 75-330 - "Consideration of an ordinance to amend the City Code pertaining to registratio: <br />of bicycles. <br /> <br /> In September, 1975, Council adopted an ordinance p~rtaining to the registration of <br />bicycles which became effective on December 1, 1975. A study of the bicycle ordinance <br />reflected a hardship on some retail sales stores because a new bicycle sometimes was not <br />uncrated and, therefore, a license decal could not be affixed to the bicycle frame as pro- <br />vided in the ordinance. This ordinance permits the retail sales stores to provide to the <br />Commissioner of Revenue the name and address of the purchaser and the serial number of the <br />bicycle purchased. The City Manager recommends adoption." <br /> <br /> The following report from the City Manager on impounding versus summonses for bicycles <br />was presented: <br /> <br /> "I was requested to look into the feasibility of issuing summonses rather than impound- <br />ment for unregistered bicycles. This investigation has revealed that other cities have <br />tried both systems and discovered that the summons method was ineffective. The use of <br />the summons requires a special 4-copy summons book and a clerk to handle the paper work <br />at considerable cost to the City. <br /> <br /> Officers in the field are given incorrect information about people relative to names, <br />addresses, etc., and most young people carry no positive identification and much time is <br />lost when trying to locate parents in order to issue a summons. In many cases, a second <br />notice had to be printed up and sent out on all delinquent summonses and, if this failed <br />to work, the people were petitioned to Juvenile Court which created additional workload <br />on the court as well as still leaving many bicycles unregistered. <br /> <br /> It is my recommendation that we retain the section of the Code allowing for the impoundm <br />of bicycles. This provision of the Code has not been abused in the past and has been on <br />the books for a number of years. The handling of impounded bicycles has posed no problems <br />since receipts are issued. The Police Department has been conducting routine spot check <br />impoundments and a high percentage of positive or assumed stolen bicycles are resulting <br />from the routine spot checks. This also increases the number of registered bicycles when <br />those that ere not stolen are returned to their owners. <br /> <br /> I feel that the amendment that has been proposed to the above ordinance will provide <br />us with additional information, especially serial numbers and names and addresses of o~ers <br />who are purchasing bicycles in order that we can better trace the stolen bicycle. This <br />report is submitted for your information as requested." <br /> <br /> On motion of Mr. Oast and seconded by Mr. Barnes, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND TIlE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY ~ENDING SECTION S-3 THEREOF, PERTAINING TO BEGISIRATION OF BICYCLES." <br /> <br />Ayes: Barnes, <br />Nays: None <br />Abstaining: Early <br /> <br />Elliott, Holley, Oast, <br /> <br />Wentz, Davis <br /> <br /> 76-15 - The f61Iowing report on repairs to tennis courts at schools and fee to p~ay <br />tennis was presented: <br /> <br /> ' I am forwarding for your information the attached report from the Director of Parks <br />and Recreation on the status of tennis facilities within the City of Portsmouth. <br /> <br /> I would like to call your attention to the paragraph on Page 2 with reference to the <br />fact that the Parks and Recreation Commission is presently holding meetings with representa5 <br />tires of Portsmouth Tennis Patrons Association in an effort to determine future construction <br />routine maintenance, etc., of tennis facilities within the City. Also, I would like to <br />point out that the Parks and Recreation Commission and its director has been in contact <br />previously with the Portsmouth Tennis Patrons Association, especially during the public <br />hearings that were held at the various locations within the City. <br /> <br /> In conclusion, they have indicated that the results and recommendations evolving from <br />the present meetings will be forwarded in the form of recommendations for inclusion into <br />the Capital Improvement requests for 1976-77. This report is submitted for your information <br />as previously requested." <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Elliott, the report to be received as infor- <br />mation in order for the City Council to review for discussion at a later date, was adopted <br />by unanimous vote. <br /> <br /> 75-293 The followingreport on working out of classification for all City employees <br />was presented: <br /> <br /> "I forward the enclosed report on working out of classification for all City employees.I <br />Based on the research that has been accomplished by the Personnel Department, working out <br />of classification appears to be minimum in all departments except the Fire Department. I <br /> <br /> The report looks into an indepth analysis of the tours of duty and the reasons for <br />a larger amount of working out of classification in this department as compared to other <br />departments. Page 4 of the report outlines the total cost involved as related to working <br />out of classification by rank and the condition of assignment. Page 5 of the report outlines <br />some questions which need to be resolved in order to clarify the status of the "Lieutenant' <br /> <br />~nt <br /> <br /> <br />
