28? <br /> <br />.lanuarv 27. 1976 <br /> <br /> WHEREAS, said hearing has been duly held and in the judgment of the Council the said <br />sidewalk should be constructed. <br /> <br />218 <br />hereby authorized. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the construction of a sidewalk in the 200 block of Florida Avenue between <br />Florida Avenue and 224 Florida Avenue, where standard sidewalks do not now exist, is <br /> <br /> 2. That the abuting landowners shall be assessed at a rate <br />foot pursuant to a petition signed by seventy five (75%) percent <br />affected by the requested improvements. <br /> <br />of $2.00 per front lineal <br />of the property owners <br /> <br /> 3. That the City Clerk forthwith caused to be recorded an abstract of this resolution, <br />together with a statement showing the ownership and location of the property to be affected <br />by the proposed sidewalk and the estimated amount that will be assessed against each abuting <br />landowner in accordance with a statement thereof on file in his office. <br /> <br />Ayes: Barnes, Early, Elliott, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 76-30 "Consideration of a resolution appointing viewers for the closing of a portion <br />of Florida Avenue between High and King Streets." <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Oast, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OF FLORIDA AVENUE BETWEEN <br />HIGH STREET AND KING STREET. <br /> <br /> WHEREAS, Portsmouth Redevelopment and Housing Authority has made application to vacate <br />and close the hereinafter described portion of a certain street, and it appearing that <br />the notice of the ~pplication and request for appointment of viewers was duly posted January <br />16, 1976, on the bulletin board of the Circuit Court of the City of Portsmouth, the bulletin <br />board of the Council Chambers of the City of Portsmouth and the bulletin board of the Genera~ <br />District Court, Civil Division, of the City of Portsmouth, Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that Linon Vann, C. E. Ellis, Frank N. Eilisoly, James V. McGehee and Raymond Tweed be <br />appointed as viewers to view the hereinafter described portion of such street and to report <br />to this Council in writing whether in their opinion, any, and if any, what inconvenience <br />would result in vacating and closing the following: <br /> <br /> All that certain piece or parcel of land lying and being in the City <br />of Portsmouth, Virginia, and comprising that portion of Florida Avenue <br />beginning 110 feet six inches, more or less, south from the southernmost <br />line of High Street which lies southerly of the western prolongation of the <br />southern property line of that property owned by Oscar Brown, et al." <br /> <br />Ayes: Barnes, Early, Elliott, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 76-31 - "Consideration of a resolution appointing viewers for the closing of a portion <br />of Westmoreland Avenue between County and Columbia Streets." <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Oast, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OF ~STMORELAND AVENUE BETWEEN <br />COUNTY AND COLUMBIA STREETS. ~ <br /> <br /> WHEREAS, David John Noland and Rebecca K. Noland have made application to vacate and <br />close the hereinafter described portion of a certain street, and it appearing that the <br />application and request for the appointment of viewers was duly posted January 7, 1976, <br />on the bulletin board of the Circuit Court of the City of Portsmouth, the bulletin board <br />of the General District Court, Civil Division, of the City of Portsmouth, the bulletin <br />board of the Juvenile and Domestic Court, of the City of Portsmouth, Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that Lenon Vann, C. E. Ellis, Frank N. Bilisoly, James V. McGehee, and Raymond Tweed be <br />appointed as viewers to view the hereinafter described portion of such street and to report <br />to this Council in writing whether in their opinion, any, and if any, what inconvenience <br />would result in vacating and closing the following: <br /> <br /> All that certain piece or parcel of land, situate in the City of Portsmouth, <br />Virginia, and being that portion of the street now knowm as Westmoreland Avenue, <br />formerly Lawrence Avenue, shown on the plat of the Portsmouth Suburban and <br />Investment Company, duly recorded in the Clerk's office of the Circuit Court <br />of the City of Chesapeake in Map Book 4, page 94, which lies between the south line <br />of County Street and the north line of Columbia Street, as shown on said platy <br /> <br />Ayes: Barnes, Ear~y, Elliott, Oast, 'Wentz, Davis <br />Nays: None <br /> <br /> <br />
