June 22, 1976 <br /> <br /> ~ UNFINISHED BUSINESS <br /> <br /> 76-1S3 - The following ordinance approved on first reading at <br />of June 7, 1976, was taken up and read: <br /> <br /> "ZONING AMENDMENT ORDINANCE Z 76~8" <br /> <br /> On motion of Mr. Barnes and seconded <br />the following vote: <br /> <br />the Public Hearing meeting <br /> <br />by Mr~ Elliott, the ordinance was adopted, and by <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast Davis <br />Nays: None ' <br /> <br /> 76-2~% The following ordinance approved on first <br />of June ?, 1976, was taken up and read: <br /> <br />(a) "~ONING ~ENDMENT ORDINANCE Z 76-14" <br /> <br />reading at the Public <br /> <br />Hearingmmeeting <br /> <br /> On motion of Mr. Early and seconded by Mr. Barnes, the ordinance was adopted and by <br />the following vote: , <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast D~vis <br />Nays: None ' <br /> <br />?6-207 On motion of Mr. Early and seconded by Mr. Barnes, the following resolution <br />approved on first reading at the Public Hearing meeting of June 7 1976 was adopted and <br />the following vote: , , , <br /> <br />by <br /> <br /> (b) "A RESOLUTION GRANTING A USE PERMIT TO OPERATE A STAFF PARKING FACILITY <br /> FOR THE PORTSMOUTH PSYCHIATRIC CENTER BETWEEN BLAIR STREET AND FORT LANE. <br /> <br /> WHEREAS, Portsmouth Psychiatric Center, Inc. has made application pursuant to <br />Section 40-78[b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting <br />of a use permit as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application and the Planning Commission has recommended the <br />granting of said use permit on condition. <br /> <br /> NOW, THEREFORE, BB IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> (a) That the use for which the use permit hereinafter described is sought,~ <br />(1) will no~ adversely affect the health and safety of persons residing or woriing in the <br />neighborhood of proposed use, (2) will not be detrimental to the public welfare or injurious <br />to property or improvements in the neighborhood, and (3) will be in accord with the purposes <br />of the Zoning Chapter of the City Code. <br /> <br /> (b) The City of Portsmouth is hereby granting a use permit pursuant to Section 40- <br />?8(b) of the City Code to operate a staff parking facility for the property described as <br />follows: <br /> <br /> Beginning at the northwest corner of Blair Street and Fort Lane; <br /> thence west along the north right-of-way line of Blair Street approximately <br /> 126 feet to a side lot line; thence north along said lin% approximately <br /> 16 feet to a rear lot line; thence east along said line approximately <br /> 126 feet to the west rightnof~way line of Fort Lane; thence south approxi- <br /> mately 116 feet to Blair Street; the point of origin. <br /> <br /> (c) The granting of this use permit is subject to the following conditions: <br /> <br /> I. A storage shed situate on the proposed staff parking facility should be removed <br /> <br /> [2. ~'~he~lack top pavement should be at least two feet from the property lines <br />and street lines. <br /> <br /> 3. A chain link fence with aluminum latticing in addition to evergreen vine plante¢ <br />in the area of the proposed proceeding located between the fence and sidmwalk to screen <br />the entire length of the chain link fence including the northwest property line. <br /> <br /> 4.
