June 22, 1976 ~ UNFINISHED BUSINESS 76-1S3 - The following ordinance approved on first reading at of June 7, 1976, was taken up and read: "ZONING AMENDMENT ORDINANCE Z 76~8" On motion of Mr. Barnes and seconded the following vote: the Public Hearing meeting by Mr~ Elliott, the ordinance was adopted, and by Ayes: Barnes, Early, Elliott, Holley, Oast Davis Nays: None ' 76-2~% The following ordinance approved on first of June ?, 1976, was taken up and read: (a) "~ONING ~ENDMENT ORDINANCE Z 76-14" reading at the Public Hearingmmeeting On motion of Mr. Early and seconded by Mr. Barnes, the ordinance was adopted and by the following vote: , Ayes: Barnes, Early, Elliott, Holley, Oast D~vis Nays: None ' ?6-207 On motion of Mr. Early and seconded by Mr. Barnes, the following resolution approved on first reading at the Public Hearing meeting of June 7 1976 was adopted and the following vote: , , , by (b) "A RESOLUTION GRANTING A USE PERMIT TO OPERATE A STAFF PARKING FACILITY FOR THE PORTSMOUTH PSYCHIATRIC CENTER BETWEEN BLAIR STREET AND FORT LANE. WHEREAS, Portsmouth Psychiatric Center, Inc. has made application pursuant to Section 40-78[b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application and the Planning Commission has recommended the granting of said use permit on condition. NOW, THEREFORE, BB IT RESOLVED by the Council of the City of Portsmouth, Virginia: (a) That the use for which the use permit hereinafter described is sought,~ (1) will no~ adversely affect the health and safety of persons residing or woriing in the neighborhood of proposed use, (2) will not be detrimental to the public welfare or injurious to property or improvements in the neighborhood, and (3) will be in accord with the purposes of the Zoning Chapter of the City Code. (b) The City of Portsmouth is hereby granting a use permit pursuant to Section 40- ?8(b) of the City Code to operate a staff parking facility for the property described as follows: Beginning at the northwest corner of Blair Street and Fort Lane; thence west along the north right-of-way line of Blair Street approximately 126 feet to a side lot line; thence north along said lin% approximately 16 feet to a rear lot line; thence east along said line approximately 126 feet to the west rightnof~way line of Fort Lane; thence south approxi- mately 116 feet to Blair Street; the point of origin. (c) The granting of this use permit is subject to the following conditions: I. A storage shed situate on the proposed staff parking facility should be removed [2. ~'~he~lack top pavement should be at least two feet from the property lines and street lines. 3. A chain link fence with aluminum latticing in addition to evergreen vine plante¢ in the area of the proposed proceeding located between the fence and sidmwalk to screen the entire length of the chain link fence including the northwest property line. 4. An approved onsite and offsite drainage system. If the conditions of this use permit are not met within one (1) year from the approval of this Resolution, this use permit is void."
