<br /> Substitute motion of Mr. Barnes and seconded by Mr. W~ntz, the following ordinance to be
<br />referred to the City Attorney for further drafting, and was adopted by unanimous vote:
<br /> "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY
<br /> ADDING TO CHA~TER 32 THEREOF, ARTICLE VI PERTAINING TO PERMITS FOR TRANSPORTATION
<br /> OF MATERIALS ON PUBLIC STREETS."
<br /> 76-327 "ConsideratRon of an ordinance to amend the City Code of the City of Portsmouth,
<br />1973, by amending Section 2-150 pertaining to the powers and duties of the City Engineer.
<br /> This amendment will remove from the duties of the City Engineer those duties and powers
<br />which are currently being performed by the Traffic Engineer. The current Code has the Traffic
<br />Engineer's functions under the powers and duties of the City Engineer. This amendment will
<br />delete this function. The City Manager recommends adoption."

<br />pertaining to Traffic Engineer.

<br /> This amendment and the addition of these two sections establish the Department of Traffic
<br />Engineering with those powers and duties which were previously assigned to the City Engineer;
<br />but, were performed by the Traffic Engineering Department. The Engineering Department from a
<br />budget and operating standpoint is classified in Public Works engineering, while the Traffic
<br />Engineer is classified in the category of Public Safety engineering. The City Manager recom-
<br />mends adoption."

<br />1973, by amending Section 32~74 thereof deleting Portsmouth Boulevard thereto and all referenc
<br />thereto pertaining to street setback lines.

<br /> The City currently'~h~s 1I streets in Section 32-74 of the City Code that require streets
<br />with setback lines 50' from the center line. This amendment will delete Portsmouth Boulevard
<br />from the requirements of this section, from Alexander's Corner to the City limits. Ail develo~
<br />ment on se~-ba~k%~n Portsmouth Boulevard in the future wilI be determined by the zone class for
<br />the ~pecific property. The City Manager redommends adoption."

<br /> 76-330 - "Consideration of an ordinance to amend the City Code of the City of Portsmouth,
<br />1973, by amending Section 32-5 thereof pertaining to construction of streets and sidewalks.
<br />
<br /> This amendment will authorize the Director of Public Works to issue permits for encroach-
<br />ment on City righC=of~wa~.~at ground level not to exceed 12 inches. Due to the fact that many
<br />residences, commercial buildings, etc., in the older part of the City were not required to
<br />comply with=setbac~ construction has taken place contiguous to the City right-of-way. There-
<br />fore any improvements, alterations, or upgrading of the facade to buildings is prohibited due
<br />to the non encroachment section of the City Code. This amendment Will authorize the Public
<br />'Works Director to issue permits to persons holding legal title to the building for encroach-
<br />ment. The City Manager ~commcnds adoption."
