August 24, 2976 <br /> <br />AM~s: Early, Elliott, Holley, Oast, ~entz, Davis <br />Nays: None <br /> <br /> 76-554 "Consideration-of a resolution to appoint viewers for the e!osing of the fol- <br />lowing streets: <br /> <br />(1) A portion of 8th Street between Madison Street and Portsmouth Boulevard. <br />(2) A portion of 9th Street between Madison and Portsmouth Boulevard. <br />(5) A portion of Portsmouth Boulevard. <br />(4) A port,on of Nelson Street. <br /> <br /> The Portsmouth Redevelopment and Housing Authority has made application to vacate and <br />close the abuse described streets. This resolution appoints viewers as required by State <br />law. This application has been reviewed by the City Planning Commission. The City Manager <br />recommends adoption." <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Oast, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING THE FOLLOWING STREETS: PARCEL I, <br />A PORTION OF EIGHTH STREET BETWEENMADISON STREET AND PORTSMOUTH BOUL~FA-~, <br />PARCEL II, A PORTION OF NINTH STREET BETWEEN MADISON AND PORTSMOUTH BOULEVARD, <br />PARCEL III, A PORTION OF PORTSMOUTH BOULEVARD BEGINNING APPROXIMATELY 150 <br />FEET PEST FROM SEVENTH STREET AND EXTENDING APPROXImaTELY 115 FEET EAST FROM <br />GREEN STREET, INVOLVING ONLY THE NORTHERN RIGHT-OF-WAY OF PORTSMOUTH BOuLE- <br />VARD, HAVING A WIDTH OF 50 FEET, PARCEL IV, A PORTION OF NELSON STREET BETWEEN <br />SIXTH AND SEVENTH STREET. <br /> <br /> WHEREAS, Portsmouth Redevelopment And Housing Authority has made application to vacate <br />and close Parcels I, II, III and IV, the hereinafter described portions of certain streets, <br />and it appearing that notice of the application and request for appointment Of viewers <br />was duly posted July 21, 1976, on the bulletin board of the Circuit Court of the City <br />of Portsmouth, the bulletin board of the City Council Chambers of the City of Portsmouth <br />and the bulletin board of the General District Court, Civil Division, of the City of Portsmout <br />Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that Frank N. Bilisoly, L. A. Clark, C. E. Ellis, Leonard L. Sullivan and Rev. J. R. Wilkersor <br />be appointed as viewers to view the hereinafter described portions of such streets and <br />to report to this Council in writing whether in their opinion, any, and if any, what inconveni <br />would result in vacating and closing the following: <br /> <br />PARCEL I - Eighth Street <br /> <br /> Beginning at the southeastern right:of-way of Madison Street and <br />Eighth Street; thence south 242 feet; thence west 60 feet; thence north <br />242 feet to the south right-of-way line of Madison Street; thence east <br />along said right-of-way 60 feet to the point of origin. <br /> <br />PARCEL II Ninth Street <br /> <br /> Beginning at the southeastern right-of-way of Madison Street and <br />Ninth Street; thence south 242 feet; thence west 60 feet;thence north <br />242 feet to the south right-of-way line of Madison Street; thence east <br />along said right-of-way 60 feet to the.point of origin. <br /> <br />Parcel III Portsmouth BouleVard <br /> <br /> A portion beginning approximately 150 feet west from Seventh Street <br />and extending approximately 115 feet east from Green Street. This closure <br />involves only the northern right-of-way of Portsmouth Boulevard, having a <br />width of 50 feet. <br /> <br />Parcel IV - NelsOn Street <br /> <br /> All that certain piece or parcel of land lying and being in the City <br />of Portsmouth, Virginia, and comprising that portion of Nelson Street <br />which is bounded on the west by the eastern right-of-way line of Seventh <br />Street and on the east by the western right-of-way line of Sixth Street." <br /> <br />Ayes: EarlM, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 76-555 - "Consideration of a motion authorizing the City Manager to execute a contract <br />with the Seaboard Coast Line Railroad for the right to ins~ll arid maintain a 56-inch storm <br />sewer across their right-of-way and uflder Tracks 1-11 and 1-15." <br /> <br /> Motion of Mr. Wentz and seconded by Mrl Elliott, to aoncur in the recommendation of <br />the City Manager and authorization be granted, was adopted by unanimous vote. <br /> <br /> 76-556 - "Consideration of a motion authorizing the City Manager to execute a lease <br />between the City of Portsmouth and the owners of property in the Middle Street Mall and the <br />Mervis Building located at 307 High Street. <br /> <br />,~n, e <br /> <br /> <br />
